THE MINISTER OF INDUSTRY AND TRADE OF VIETNAM
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade of Vietnam;
Pursuant to the Government’s Decree No. 31/2018/ND-CP dated March 08, 2018 providing guidelines for implementation of the Law on Foreign Trade Management regarding origin of goods;
Pursuant to the Circular No. 38/2018/TT-BCT dated October 30, 2018 prescribing certification of origin of goods under the Generalised System of Preferences of the European Union, Norway, Switzerland and Turkey;
In consideration of the request of the Vietnam Chamber of Commerce and Industry at the Official Dispatch No. 2379/PTM-TTXN dated November 15, 2022;
At the request of the Director of the Agency of Foreign Trade,
HEREBY DECIDES:
Article 1. Vietnam Chamber of Commerce and Industry (VCCI) is authorized to organize the registration and revocation of registered exporter numbers (hereinafter referred to as “REX number”) under the Generalised System of Preferences (GSP system) of Norway and Switzerland.
1. Provide personnel and facilities for its affiliated units in charge of receiving applications for REX number, and organize the registration and revocation of number as prescribed;
2. Provide guidelines for certification of origin of goods under the GSP system; reply to queries of traders in a public, transparent and convenient manner;
3. Manage and protect confidentiality of information about applicants for REX number and about goods whose origin is certified under the GSP system; submit reports to the Ministry of Industry and Trade of Vietnam on the implementation of mechanism for certification of origin of goods under the GSP system on a periodical or ad hoc basis or at the request of the Ministry of Industry and Trade of Vietnam;
4. Connect data on proofs of origin issued under the GSP system and documents concerning the export shipments with the electronic certificates of origin system (eCoSys) of the Ministry of Industry and Trade of Vietnam;
5. Act as the contact point in charge of receiving and responding to requests for examination and verification of origin of exported goods of competent authorities of importing countries.
6. Proactively monitor, expedite and inspect the certification of origin of goods under the GSP system by traders, relevant organizations and individuals, and cooperate with competent authorities in conducting examination and verification of origin of goods;
7. Provide the Ministry of Industry and Trade of Vietnam with the (updated) list of its affiliated units in charge of receiving applications for REX number, and comply with guidelines given the Ministry of Industry and Trade of Vietnam on receipt of applications for REX number.
Article 3. If VCCI’s affiliated units commit violations against regulations on receipt of applications for REX number, VCCI shall, depending on the severity of each violation, take appropriate actions against such violations, and may suspend the receipt of applications for REX number by the violating unit if it is deemed necessary.
Article 4. This Decision comes into force from January 01, 2023 to December 31, 2027 inclusively.
Article 5. The following Decisions are abrogated:
1. The Decision No. 4173/QD-BCT dated November 06, 2018 of the Minister of Industry and Trade of Vietnam prescribing authorization to the Vietnam Chamber of Commerce and Industry to receive applications for registered exporter number under the generalised system of preferences of the European Union, Norway, Switzerland and Turkey.
2. The Decision No. 76/QD-BCT dated January 21, 2022 of the Minister of Industry and Trade of Vietnam on extension of duration of authorization to receive applications for registered exporter number under the generalised system of preferences of the European Union, Norway, Switzerland and Turkey.
Article 6. Chief of the Ministry Office, Director of the Agency of Foreign Trade, President of Vietnam Chamber of Commerce and Industry, and relevant organizations and individuals are responsible for the implementation of this Decision./.
