Decision No. 2647/QD-BCT dated October 08, 2024 on approval for price bracket for electricity imported from Laos to Vietnam from December 31, 2025

DECISION

ON APPROVAL FOR PRICE BRACKET FOR ELECTRICITY IMPORTED FROM LAOS TO VIETNAM FROM DECEMBER 31, 2025

THE MINISTER OF INDUSTRY AND TRADE OF VIETNAM

Pursuant to Law on Electricity dated December 3, 2004 and Law on amendments to Law on Electricity dated November 20, 2012;

Pursuant to Decree No. 96/2022/ND-CP dated November 29, 2022 of the Government on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade; Decree No. 105/2024/ND-CP dated August 01, 2024 amending certain Articles of Decree No. 96/2022/ND-CP and Decree No. 26/2018/ND-CP dated September 28, 2018 of the Government on Charter of organization and operation of Vietnam Electricity;

Pursuant to Decree No. 137/2013/ND-CP dated October 21, 2013 of the Government of Vietnam elaborating implementation of certain Articles of the Law on Electricity and the Law on amendments to certain Articles of the Law on Electricity;

Pursuant to the Agreement on Cooperation in the Development of Power and Mining Power Works between the Government of the Lao People's Democratic Republic and the Government of the Socialist Republic of Vietnam in 2019;

Pursuant to the Agreement on the Cooperation Plan between the Government of the Lao People's Democratic Republic and the Government of the Socialist Republic of Vietnam in 2024;

Pursuant to the Prime Minister's Document No. 241/TTg-QHQT dated February 23, 2019 and No. 397/TTg-QHQT dated April 4, 2020 on principles and prices of electricity imported from Laos to Vietnam;

Pursuant to the Government Office’s Notification No. 7694/VPCP-QHQT dated October 05, 2023 of the Deputy Prime Minister's comments on Vietnam's outward investment in 2022 and the first 7 months of 2023;

Pursuant to Decision No. 262/QD-TTg dated April 01, 2024 of the Prime Minister on approval for the Plan to implement the national power development planning for 2021 - 2030 period, with a vision toward 2050;

Pursuant to Resolution No. 128/NQ-CP dated September 08, 2024 of the Government on the Government’s regular meeting in August, 2024;

At the request of the Vietnam Electricity in Document No. 2938/EVN-TTD dated May 23, 2024 and the proposal of the Director of the Electricity Regulatory Authority.

HEREBY DECIDES:

Article 1. Promulgation of a price bracket for electricity imported from Laos to Vietnam from December 31, 2025

The price bracket for electricity imported from Laos to Vietnam for hydropower plants and wind power plants operating commercially from December 31, 2025 is as follows:

- Maximum price for hydropower plants: 6,78 USCent/kWh;

- Maximum price for wind power plants: 6,4 USCent/kWh;

- The price bracket for electricity imported from Laos to Vietnam applies to power plants operating commercially in the period from December 31, 2025 to December 31, 2030 inclusive.

Article 2. Organization of implementation

1. Pursuant to the price bracket for electricity imported from Laos specified in Article 1 of this Decision, Vietnam Electricity and the power generating unit shall negotiate the power purchase price on the principle that benefits are harmonized and risks are shared and according to the market mechanism and market price, ensuring the principle of maximum savings in power generation costs and competitiveness compared to electricity prices in Vietnam.

2. Vietnam Electricity shall monitor and promptly submit reports to the Ministry of Industry and Trade in case of major fluctuations in the parameters for calculating the price bracket for electricity imported from Laos.

Article 3. Implementation clauses

1. This Decision comes into force from the day on which it is signed.

2. Chief of the Ministry Office, Director of the Electricity Regulatory Authority of Vietnam, Director of the Electricity and Renewable Energy Authority, Director of Department of Legal Affairs, General Director of Vietnam Electricity and relevant organizations and individuals are responsible for implementation of this Decision./.
