DECREE
POLICIES APPLICABLE TO SENIOR SPECIALISTS
Pursuant to the Law on Government Organization dated February 18, 2025;
Pursuant to the Law on Officials and Public Employees dated November 13, 2008; the Law on Public Employees dated November 15, 2010; the Law on amendments to the Law on Officials and the Law on Public Employees dated November 25, 2019;
At the request of the Minister of Home Affairs;
The Government promulgates Decree on policies applicable to senior specialists.
Article 1. Scope
This Decree provides for policies applicable to senior specialists; guidance on employment of senior specialists who are foreigners and overseas Vietnamese citizens and work for central authorities affiliated to the Communist Party and the State, including:
1. Organization Commission of the Central Committee.
2. Propaganda and Mass Mobilization Department of the Central Committee.
3. Central Internal Affairs Committee.
4. Central Policy and Strategy Committee.
5. Central Inspection Commission of the Central Committee.
6. Central Committee's Office.
7. Office of the President of Vietnam
8. Government Office.
9. Office of the National Assembly.
Article 2. Regulated entities
Senior specialists specified in Article 1 of this Decree refer to persons who meet standards and conditions and are appointed by competent authorities according to the Regulation No. 180-QD/TW dated July 11, 2024 of the Central Secretariat on senior specialists, including:
1. Officials and public employees.
2. Retired persons, persons working outside of the political system (who are not on the payroll of organizations of the political system, including Vietnamese citizens and foreigners).
Article 3. Policies applicable to senior specialists who are officials and public employees
If a person specified in clause 1 Article 2 of this Decree who is holding the leadership or management position and receiving official/public employee grade-, rank- or title-based salary plus leadership allowances, or does not hold the leadership or management position is appointed as a senior specialist, he/she shall cease to hold his/her previous position from the date of appointment, start to receive a new salary according to the senior specialist salary table issued together with the Government’s Decree No. 204/2004/ND-CP dated December 14, 2004 and be entitled to policies. To be specific:
1. In case he/she is holding the leadership or management position with a position allowance coefficient of 0.9 or less or does not hold the leadership or management position, he/she is entitled to the policies, including:
a) A salary of step 1 multiplied by a coefficient of 8,80 in the senior specialist salary table;
b) Policies related to civil services, equivalent to those applicable to Assistants to senior leaders of the Communist Party and the State.
2. In case he/she is holding the leadership or management position with a position allowance coefficient ranging from 1,0 to 1,25, he/she is entitled to the policies, including:
a) A salary of step 2 multiplied by a coefficient of 9,40 in the senior specialist salary table;
b) Policies related to civil services, equivalent to those applicable to Deputy Ministers.
3. In case he/she is holding the leadership or management position with a position allowance coefficient of 1,30 or more, he/she is entitled to the policies, including:
a) A salary of step 3 multiplied by a coefficient of 10,0 in the senior specialist salary table;
b) Policies related to civil services, equivalent to those applicable to Ministers.
4. In case the new salary coefficient is lower than the total previous salary coefficient (including grade, rank- or title-based salary coefficient plus leadership allowances and extra-seniority allowance, if any), the new coefficient will be increased to match the previous coefficient (the increase will be equal to the difference between the previous coefficient and the new coefficient).
5. Authorities employing senior specialists may, according to the efficiency in the performance of tasks by senior specialists and their resource capacity, provide some of additional policies (bonuses, working conditions, etc.) in conformity with their practical situations.
6. After an official/public employee ceases to act as a senior specialist, if he/she is appointed to a new position by his/her competent management authority, according to official/public employee grade-, rank- or title-based salary to which he/she is entitled before he/she is appointed to act as the senior specialist and the duration during which he/she acts as the senior specialist, the competent management authority shall pay him/her a higher salary within the same pay grade and the official/public employee shall be entitled to salary and allowance policies (if any) associated with the new position according to regulations.
Article 4. Policies applicable to retired persons and persons working outside of the political system specified in clause 2 Article 2 of this Decree
1. Heads of authorities shall agree with persons expected to be selected and appointed as senior specialists on salaries and policies that must not exceed the limits specified in clause 3 Article 3 of this Article, on a case-by-case basis, in accordance with policies applicable to senior specialists that are officials and public employees before requesting competent authorities to appoint them as senior specialists to serve as a basis for signature of task contracts.
2. Authorities employing senior specialists that are foreigners and overseas Vietnamese citizens specified in this Article shall comply with regulations of laws on labor, state secrets, relevant laws and working regulations issued by authorities.
Article 5. Funding
1. Funding for implementation of policies applicable to senior specialists shall be covered by state budget according to applicable hierarchy.
2. The Ministry of Finance shall request competent authorities to grant funding for implementation of policies applicable to senior specialists specified in this Decree in accordance with the law on state budget.
Article 6. Responsibility for implementation
Authorities employing senior specialists shall, within their assigned tasks and functions, employ and implement policies applicable to senior specialists according to regulations in this Decree.
Article 7. Entry into force
This Decree enters into force from June 15, 2025.
Article 8. Responsibility for implementation
Authorities specified in Article 1 of this Decree and relevant organizations and individuals shall be responsible for implementing this Decree.
