Decree No. 92/2022/ND-CP dated November 03, 2022 on functions, tasks, powers and organizational structure of Voice of Vietnam

DECREE

ON FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF VOICE OF VIETNAM

Pursuant to the Law on Governmental Organization dated June 19, 2015; Law on amendments to the Law on Governmental Organization and the Law on Local Government Organization dated November 22, 2019;

Pursuant to Decree No. 10/2016/ND-CP dated February 01, 2016 of the Government on regulations on Governmental Offices and Decree No. 47/2019/ND-CP dated June 05, 2019 of the Government on amendments to Decree No. 10/2016/ND-CP ;

At the request of the Minister of Information and Communications;

The Government of Vietnam promulgates a Decree on functions, tasks, powers and organizational structure of Voice of Vietnam.

Article 1. Positions and functions

1. The Voice of Vietnam is an agency directly controlled by the Government of Vietnam, the Vietnamese national radio broadcaster, a key multimedia agency tasked with propagating the policies of the Party and the laws of the state; contributes to educate and raise people's intellectual standards, serve the people's spiritual life by radio programs and other forms of press and multimedia communications.

2. The Voice of Vietnam is the international trade name in English and is abbreviated to “TNVN” in Vietnamese and “VOV” in English.

3. The VOV is under the state management of the Ministry of Information and Communications in terms of the press.

Article  2. Tasks and entitlements

The VOV shall fulfill tasks and entitlements prescribed in Decree No. 10/2016/ND-CP dated February 01, 2016 of the Government on regulations on Governmental Offices and Decree No. 47/2019/ND-CP dated June 05, 2019 of the Government on amendments to Decree No. 10/2016/ND-CP and the following specific tasks and entitlements:

1. Develop long-term, medium-term and annual strategies, programs and plans and significant projects of the VOV, submit them to the Government and Prime Minister and organize the implementation thereof after being approved.

2. Do researches and propose developing national standards and appealing to competent authorities to publish them; promulgate grassroots standards in accordance with regulations of law.

3. Decide and be responsible for contents, programs and time limit for daily broadcasting on program channels of the VOV, coverage and target audience of internal and external information; direct and guide press agencies affiliated to the VOV to strictly comply with principles, purposes, tasks, directions of operation in accordance with regulations of law.

4. Participate in formulating strategies, programming and plans for developing Vietnam's press system.

5. Organize manufacture, transmission, broadcasting, publication and storage of radio and TV programs, electronic newspapers and printing newspapers in accordance with regulations of law.

6. Manage and decide investment and construction projects within its competence in accordance with law; participate in verifying important projects and plans within its professions at the request of the Government of Vietnam or Prime Minister.

7. Directly manage technical systems of the VOV specialized in manufacturing contents of domestic programs and international program channels; transmitting signals thereof on telecommunications infrastructures and broadband internet; broadcasting them via terrestrial and satellite radio modes; providing them on digital platforms of the VOV and others in accordance with regulations of law.

8. Organize the conduct of research and application of scientific and technological progress and digital transformation in the operation of the VOV.

9. Require international cooperation in terms of fields under the VOV's functions, tasks and powers in accordance with regulations of law.

10. Implement the financial autonomy mechanism in accordance with law; in the special case, the VOV shall propose and cooperate with relevant ministries and agencies in developing regulations on the specific financial autonomy mechanism of the VOV and submitting them to competent authorities for promulgation thereof.

11. Exercise rights and responsibilities of representing the state owners for enterprises established by the VOV and for capital contributions in enterprises in accordance with law.

12. Decide and direct the execution of programs for administrative reform of the VOV according to targets and contents of the programs for state administrative reform approved by the Government and Prime Minister of Vietnam.

13. Organize professional training in journalism in accordance with regulations of law.

14. Manage its organizational apparatus, officials and workers; organize appointment, re-appointment, transfer, rotation, dismissal, training, refresher training, commendation and disciplinary actions; implement the salary regime and other regimes and policies for public employees and workers under their management as prescribed by law.

15. Manage and use public property and budgets in accordance with law on state budget, law on management and use of public property and related laws.

16. Organize activities of providing services as prescribed by law.

17. Report to the Government, the Prime Minister, the Ministry of Information and Communications and competent agencies in accordance with law.

18. Perform other tasks and entitlements assigned by the Government or Prime Minister in accordance with law.

10. Department of Foreign Affairs (VOV5).

11. Department of Literature and Arts (VOV6).

12. VOV online site (VOV.VN).

13. VOV News.

14. VTC Digital Television.

15. Voice of Vietnam Television Channel (VOVTV).

16. VOV Transportation Network.

17. Resident Office in the Northeastern region.

18. Resident Office in the Northwestern region.

19. Resident Office in the Central Vietnam.

20. Resident Office in the Central Highlands.

21. Resident Office in Ho Chi Minh City.

22. Resident Office in the Mekong delta region.

23. Overseas resident offices established in accordance with law.

24. Center for Program Production and Storage.

25. Center for Audio Broadcasting Techniques.

26. Center for Advertisement and Multimedia Services.

27. Center for Research and Development of Multimedia Technology (R&D).

Units prescribed in clauses 1 through 5 of this Article are assisting organizations of the General Manager; units prescribed in Clauses 6 through 24 of this Article are manufacturing organizations of contents and programs; the unit prescribed in Clause 25 of this Article is a transmitting and broadcasting organization; units prescribed in clauses 26 and 27 of this Article are public service providers.

The Editorial Secretariat has 5 divisions, the Department of Planning and Finance has 02 divisions, the Office has 05 divisions.

Article 4. Direction

1. The VOV has a General Manager and no more than 04 Deputy General Managers.

2. General Manager and Deputy General Managers appointed or dismissed by the Prime Minister according to regulations of law.

3. General Manager shall be responsible before the Government, the Prime Minister and before the law for the entire operations of the VOV; Deputy General Managers shall assist the General Manager and be responsible before the General Manager and the law for assigned fields.

4. General Manager shall appoint, dismiss and discipline heads and deputy entities of such heads and formulate functions, tasks, powers, organizational structures and work relations of affiliated units.

Article 5. Effect

1. This Decree takes effect from November 10, 2022.

2. This Decree replaces Decree No. 03/2018/ND-CP dated January 04, 2018 of the Government of Vietnam on function, tasks, powers and organizational structure of the VOV.

Article 6. Responsibility for implementation

Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the People's Committees of provinces and central-affiliated cities are responsible for implementation of this Decree.
