DEFINING FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF MINISTRY OF FINANCE OF VIETNAM
Pursuant to the Law on Government Organization dated February 18, 2025;
At the request of the Minister of Finance of Vietnam;
The Government promulgates a Decree defining the functions, tasks, powers and organizational structure of the Ministry of Finance of Vietnam.
Article 1. Position and functions
The Ministry of Finance of Vietnam is a governmental agency performing the state management of: socio-economic development strategies/plans; plannings; development investment, business investment in Vietnam and outward business investments made by Vietnamese entities, investment promotion; state budget; state funds; public debts; foreign aid to Vietnam and aid given by Vietnam to foreign countries; taxes, fees, charges and other revenues of state budget; state reserves; finance of off-budget state financial fund; public property; customs; accounting; auditing; prices; securities; insurance; bidding; enterprises, collective-based businesses, cooperative business entities, household businesses; economic zones; financial services and other services under state management of the Ministry of Finance; statistics; implementation of social insurance and health insurance policies, representatives of owner of state capital invested in enterprises in accordance with regulations of law.
Ministry of Finance of Vietnam shall fulfill the tasks and exercise the powers prescribed in the Law on Government Organization, the Decree defining functions, tasks, powers and organizational structures of ministries and ministerial agencies, and the following specific tasks and powers:
1. Submit the following documents to the Government, including bills, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft decrees, draft resolutions of the Government according to the Ministry's approved annual law-making programs/plans, and other programs, projects and schemes as assigned by the Government or the Prime Minister.
2. Submit the following documents to the Government and/or Prime Minister, including annual, medium-term and long-term development strategies, plannings, programs or plans in the fields under its management; draft decisions, directives and other documents of the Prime Minister in accordance with regulations of law.
3. Promulgate circulars, decisions, directives and other documents within the scope of its management.
4. Direct, instruct, inspect and organize the implementation of legislative documents, policies, strategies, plannings and plans after they are promulgated or approved and other legislative documents within the scope of its management; disseminate information on and educate about laws in the fields within the scope of its management.
5. Regarding socio-economic development strategies/plans; strategies/plans for development of industries or sectors under its management; plannings
a) Formulate national 5-year and annual socio-economic development plans, socio-economic development strategies; strategies/plans for development of fields and industries or sectors under its management; national comprehensive plannings, regional plannings; plans for implementation, policies, solutions, allocation of resources, and announcement of national comprehensive plannings and regional plannings after they are approved;
b) Formulate the Government's action programs for implementation of 5-year socio-economic development plans after they are approved by the National Assembly; provide advice for the Government and the Prime Minister on socio-economic general mechanisms/policies and those for cooperation in macroeconomic management and administration; assist the Government in directing the implementation of plans in some fields and industries or sectors as assigned by the Government or the Prime Minister;
c) Consolidate major macroeconomic balances of the national economy; propose solutions for maintaining balances according to strategic objectives and plans, ensuring the achievement of objectives of socio-economic development plans;
d) Formulate or provide advice on mechanisms/policies for mobilization and use of development resources for implementing socio-economic development strategies/plans, forms and methods of development investment, development of economic types, restructuring of economy associated with innovation of growth model, coordination or regulation of regional and inter-regional development;
dd) Provide guidelines for ministries, regulatory authorities and local governments in monitoring and assessing the implementation of their plans; organize monitoring, assessment and reporting on nationwide implementation of socio-economic development plans on monthly, quarterly, annual, medium-term and 5-year basis;
e) Play the leading role in appraising provincial planning formulation tasks and provincial plannings; request the Government to establish councils in charge of appraising national comprehensive planning formulation tasks, councils in charge of appraising national comprehensive plannings; request the Prime Minister to establish councils in charge of appraising regional planning formulation tasks, councils in charge of appraising regional plannings;
g) Provide guidelines for ministries, ministerial agencies and provincial People's Committees in preparing and organizing the implementation of plannings.
6. Regarding state budget management
a) Consolidate, formulate and submit the following documents to the Government, including national 05-year financial plans, national 03-year state budget - financial plans; state budget estimates and plans for allocation of annual central government budget as prescribed in the Law on state budget; adjustments to national 05-year financial plans, state budget estimates and plans for allocation of annual central government budget (if any); play the leading role in considering and proposing total funding amounts for recurrent expenditures to be allocated to national target programs during formulation and submission thereof to competent authorities for approval; balancing and allocating annual funding for recurrent expenditures for implementing these programs after they are approved;
b) Formulate and submit the following documents to the Government, including plans for addition of increase in state budget revenues to state budget estimates, plans for allocation and use of increase in revenues and unused amount of funding for expenditures of the central government budget, and plans for adjustment of state budget estimates as prescribed;
c) Formulate and submit draft decisions on assignment of state budget collection and spending tasks to each of ministries, ministerial agencies, Governmental agencies and other central-level agencies, state budget collection and spending tasks, distribution ratio (%) of revenues to be distributed among state budget levels, and additional amounts transferred from central government budget to each provincial government budget as prescribed in the Law on state budget to the Prime Minister;
d) Make decisions within its competence or request the Prime Minister to make decisions on use of state budget reserves, use of central financial reserve funds and other financial reserves in accordance with regulations of law;
dd) Play the leading role and cooperate with relevant ministries, ministerial agencies, Governmental agencies, other central-level agencies and provincial People's Committees in formulating and submitting regulations on allocation norms, and regimes, standards and norms on state budget expenditures as prescribed in the Law on state budget to the Government or Prime Minister for promulgation or promulgate such regulations within its competence;
e) Provide guidance on requirements, contents and time limits for formulation of 05-year financial plans, 03-year state budget - financial plans, annual state budget estimates; announce the checked estimate of state budget revenues, total amount of state budget’s funding for recurrent expenditures sorted by each field of recurrent expenditures of ministries, Governmental agencies, and other central-level agencies; total state budget revenues in locality and estimate of funding for budget balancing of each province or central-affiliated city;
g) Organize implementation of state budget, administration of central government budget within its competence; monitor and expedite the organization of implementation of state budget estimates at all levels;
h) Inspect the distribution of state budget estimates allocated to ministries, ministerial agencies, Governmental agencies, and other central-level agencies; provide guidance on management and administration of state budget of ministries, regulatory authorities and local governments; direct and inspect implementation of state budget collection and spending tasks of ministries, ministerial agencies, Governmental agencies, other central-level agencies and local governments;
i) Organize, direct recording and statement of state budget revenues and expenditures, and submit periodical reports on implementation of estimates of state budget revenues and expenditures in accordance with regulations of law;
k) Appraise, consolidate state budget final statements of ministries, ministerial agencies, Governmental agencies, and other central-level agencies; consolidate final statements of local government budgets according to the Law on state budget; make and submit consolidated state budget general statement to the Government for further submission to the National Assembly for approval;
l) Advance central government budget’s funding for covering expenditures within its competence or under decisions issued by competent authorities as prescribed in the Law on state budget and other documents providing guidelines for implementation thereof;
m) Recover central government budget’s funding advanced for covering expenditures;
n) Prepare and submit nationwide state financial reports to competent authorities in accordance with regulations of law;
o) Play the leading role and cooperate with relevant ministries and authorities in formulating and submitting financial policies and solutions under state management of the Ministry of Finance which are aimed at controlling and fighting inflation or deflation in the economy to the Government for its consideration and decision.
7. Regarding development investment
a) Assist the Government in consistently performing state management of public investment, investment in the form of Public-Private Partnerships (PPP) and other development investment; promulgate or submit legislative documents on public investment, PPP investment and other development investment, and general regulations on management of national target programs to competent authorities for promulgation;
b) Play the leading role and cooperate with relevant ministries, regulatory authorities and local governments in formulating rules, criteria and norms for allocation of state budget-derived public investment funding; formulating rules and criteria for allocation of funding for large-scale key projects promoting inter-regional connection as well as national and regional socio-economic development;
c) Play the leading role in and make general consolidation of development investment; determine total amount and structure of development investment funding for the whole society, annual and medium-term and annual public investment plans/adjustments thereto; submit reports to competent authorities for allocation of state budget-derived public investment plans, determine state budget’s funding for national development investment, sorted by fields and industries or sectors, in annual and 03-year financial plans; consolidate total funding for national target programs, public investment programs, nationally significant projects, large-scale key projects with substantial impact on others, promoting inter-regional connection, and meaningful in promoting both regional and local socio-economic development, and list of central government budget-funded programs, tasks and projects included in medium-term public investment plans;
d) Play the leading role in and cooperate with relevant authorities in appraising funding sources and capacity of balancing funding for national target programs, nationally significant projects, and public investment programs/projects subject to investment policy decisions issued by the Government or Prime Minister;
dd) Provide the Government and/or Prime Minister with reports on implementation of plans, disbursement of public investment funding, final statements of finished projects using public investment funding, and make public disclosure of such reports as prescribed;
e) Act as a standing member of the State Appraisal Council in charge of appraising national target programs, projects subject to investment policy approval given by the National Assembly; act as a standing member of the Interdisciplinary Appraisal Council in charge of appraising PPP projects subject to investment policy decisions issued by the Prime Minister; appraise investment policies of other programs/projects subject to investment policy decision or approval issued or given by the Prime Minister in accordance with regulations of the Law on Public Investment and the Law on PPP Investment;
g) Carry out inspection, supervision and comprehensive assessment of investment activities; examine, inspect and supervise public investment and PPP investment programs/projects in accordance with regulations of law;
h) Play the leading role in performing state management of industrial parks and economic zones, free trade zones and other forms of economic zones; propose models, mechanisms and policies for development of industrial parks and economic zones, free trade zones and other forms of economic zones; appraisal of establishment, expansion and modification of boundaries of economic zones, free trade zones and other forms of economic zones.
8. Regarding business investment in Vietnam and outward business investment made by Vietnamese entities; investment promotion
a) Manage business investment activities in Vietnam and outward business investment made by Vietnamese entities; organize investment promotion activities, provide guidelines on investment procedures;
b) Play the leading role in appraising investment policies of investment projects subject to investment policy approval given by the Prime Minister and the National Assembly as prescribed in the Law on Investment;
c) Follow procedures for issuance, modification and termination of validity of outward investment registration certificates;
d) Provide guidelines on processing, updating and reporting on difficulties and petitions faced and made by investors during the application and implementation of regulations of law to their business investment activities;
dd) Organize inspection, supervision and assessment of domestic investment, foreign investment and outward investment activities as prescribed by law.
9. Regarding taxes, fees, charges and other state budget revenues
a) Play the leading role and cooperate with relevant authorities in formulating and submitting legislative documents on taxes, fees, charges and other state budget revenues to competent authorities for promulgation, and provide guidelines on and inspect the implementation of such documents;
b) Consistently manage, direct and inspect organization of collection of taxes, fees, charges and other state budget revenues in accordance with regulations of law by tax authorities, customs authorities and other authorities assigned by the State to take charge of collecting fees, charges or other state budget revenues;
c) Make decisions within its competence or request competent authorities to make decisions on exemption, reduction, refund, arrears collection, debt cancellation, deferral of late payment interest, fines related to taxes, fees, charges and other state budget revenues as prescribed by law and other issues that arise during the implementation of bilateral or multilateral conventions/agreements on taxes, fees, charges and other state budget revenues;
d) Promulgate regulations on operational process/procedures for collection and payment of taxes, fees, charges and other state budget revenues in accordance with regulations of law; provide operational guidelines on declaration, calculation and payment of taxes, fees, charges and other state budget revenues, and other relevant operational tasks;
dd) Inspect and control state budget’s revenues, compliance with regulations of law on state budget collection and payment, and take actions within its competence against violations against regulations on taxes, fees, charges and other state budget revenues in accordance with regulations of law;
e) Carry out assessment of the conformity of policies on taxes, fees, charges and other state budget revenues with other mechanisms and policies in force, and actual socio-economic status in each period of time as the basis for making adjustments or modifications thereto within its competence or requesting competent authorities to make such adjustments or modifications.
10. Regarding management of state budget funds, state reserve funds, off-budget state financial funds and management of state funds
a) Consistently manage, direct, inspect and assume responsibility for state budget funds, state funds at the State Treasury; manage state reserve funds and off-budget state financial funds in accordance with regulations of law;
b) Organize payment of state budget expenditures according to allocated estimates when such expenditures meet conditions as prescribed by the law on state budget;
c) Carry out control, settlement, payment and final statement of state budget expenditures paid through the system of State Treasuries in accordance with regulations of law;
d) Provide professional guidelines on collection and payment, settlement and reporting on revenues and expenses of state budget funds; handle within its competence violations against regulations of law on state budget funds, state reserve funds and off-budget state financial funds;
dd) Promulgate or request competent authorities to promulgate financial management mechanisms applicable to off-budget state financial funds; instruct, inspect management and use of off-budget state financial funds.
11. Regarding management of state reserves
a) Play the leading role and cooperate with relevant ministries and regulatory authorities in formulating and submitting lists/detailed lists of national reserve commodities, total national reserve, and national reserve plans to competent authorities;
b) Promulgate national technical regulations and technical-economic norms on management of quality of national reserve commodities, and standards for national reserve storage facilities (except those standards for national reserve storage facilities falling under the jurisdiction of the Ministry of Public Security of Vietnam and the Ministry of National Defence of Vietnam) in accordance with regulations of law;
c) Promulgate regulations on financial management regimes, maximum buying prices, minimum selling prices, prices used as the basis for making compensation for damage to national reserve commodities, costs of purchase, sale, import, export, preservation, insurance, and use of national reserve commodities for relief and aid purposes in accordance with regulations of law;
d) Based on state budget estimates and approved national reserve plans, ensure financial sources for covering costs of national reserve activities performed by ministries and authorities in charge of managing national reserve commodities; appraise and consolidate final statements of state budget’s funding for national reserve-related expenses;
dd) Carry out national reserve inspections in accordance with regulations of law;
e) Organize implementation of regulations on management, preservation, import, export, purchase, sale, replacement of national reserve commodities in accordance with regulations of law.
12. Regarding management of public property
a) Consistently perform state management of public property in accordance with regulations of law; play the leading role and cooperate with relevant ministries, regulatory authorities and local governments in formulating and submitting legislative documents on management, use and operation of public property, and purchase, requisition of property to competent authorities for promulgation as prescribed by laws;
b) Play the leading role in formulating regulations on criteria and norms for use of public property, and promulgate them within its competence, or submit them to the Government or Prime Minister for promulgation according to their assignment;
c) Make decisions within its competence or request the Prime Minister to make decisions on establishment of ownership, allocation, circulation, transfer, sale and assignment of public property in accordance with regulations of law;
d) Announce the list of goods and services to be procured through national centralized procurement within its competence and the roadmap for implementation thereof decided by the Prime Minister; play the leading role and cooperate with relevant authorities in providing guidelines on centralized procurement in accordance with regulations of law;
dd) Give opinions about schemes/plans for use of public property for entering into joint ventures or associations; schemes for operation of public property as prescribed in the Law on management and use of public property;
e) Instruct and inspect the implementation of regulations of law on management and use of public property as prescribed by laws; prepare and submit consolidated reports on nationwide management and use of public property to the Government for submission to the National Assembly; carry out statistics, analysis, forecasting and public disclosure of public property.
13. Regarding management of bidding activities
a) Consistently perform state management of bidding activities in accordance with regulations of law; play the leading role in formulating and submitting legislative documents prescribing contractor selection and investor selection as prescribed in the law on bidding and the law on PPP investment to competent authorities for promulgation;
b) Play the leading role in designing templates of documents used in contractor selection and investor selection as prescribed in the law on bidding and the law on PPP investment, and promulgate them within its competence;
c) Organize appraisal of contractor selection master plans and contractor selection plans which are subject to decisions made by the Prime Minister and other cases as assigned by the Prime Minister in accordance with regulations of law;
d) Instruct and inspect implementation of regulations of law on contractor selection and investor selection as prescribed in the law on bidding and the law on PPP investment; prepare and submit annual consolidated reports on performance of bidding activities to the Prime Minister.
14. Regarding management of State capital invested in enterprises; registration, development and financial management of enterprises, collective-based businesses and household businesses
a) Play the leading role and cooperate with relevant ministries and regulatory authorities in formulating and submitting programs, plans, mechanisms and/or policies for registration and development of enterprises, collective-based businesses and household businesses; policies for improvement of business investment environment; corporate financial management mechanisms applicable to enterprises of all economic types; financial management mechanisms which are aimed at serving the implementation of policies for development of collective-based businesses and cooperatives to the Government or Prime Minister for promulgation within their competence;
b) Play the leading role and cooperate with relevant ministries and regulatory authorities in formulating and submitting programs, plans, mechanisms and/or policies for arrangement and innovation of state-invested enterprises; mechanisms for management, investment in, supervision and inspection of state capital invested in enterprises; conversion of public administrative units to enterprises; mechanisms for management and use of the State’s financial supports for enterprises, collective-based businesses and cooperatives which are derived from state budget and other State’s funding sources to the Government or Prime Minister for promulgation within their competence;
c) Play the leading role or participate in investment of State capital in and provision of the State's financial supports for enterprises; monitor, supervise, check and inspect the investment of State capital in enterprises after obtaining approval from competent authorities; implement policies upon arrangement or restructuring of state capital invested in enterprises in accordance with regulations of law; monitor and make consolidated report on arrangement and innovation of state-invested enterprises nationwide;
d) Organize supervision and inspection of investment of state capital in enterprises by capital owner’s representative agencies in accordance with regulations of law;
dd) Cooperate with capital owner’s representative agencies in formulating and implementing plans for supervision of enterprises; carry out thematic supervisions or other supervisions at the request of the Government or the Prime Minister; submit recommendations or proposed solutions for management and investment of state capital in enterprises to capital owner’s representative agencies;
e) Cooperate in assessment of business performance of state-invested enterprises, and performance of state capital representatives at enterprises in accordance with regulations of law;
g) Perform rights and responsibilities of capital owner’s representative agencies in respect of state capital invested in enterprises as prescribed by laws and assigned by the Government or the Prime Minister;
h) Consolidate, analyze, assess and formulate, seek the Prime Minister’s decision on plans for regulating funding sources and funds of state-invested enterprises in accordance with the Government’s regulations;
i) Prepare and submit consolidated reports on business efficiency and provision of public utility goods and services as assigned, and on restructuring, equitization and divestment nationwide to the Prime Minister or the Government; carry out detailed review of financial statements of state-invested enterprises at the request of the Prime Minister;
k) Manage registration of enterprises, cooperative business entities and household businesses; provide guidelines on procedures for registration of enterprises, cooperative business entities and household businesses; inspect, monitor and make consolidated reports on business registration, online business registration and post-registration management nationwide;
l) Carry out nationwide verification and consolidation of annual reports on management and investment of state capital in enterprises of capital owner’s representative agencies for submitting a consolidated report thereon to the Government for further submission to the National Assembly;
m) Give assistance in innovation and running start-up businesses; renovation of growth model on the basis of science and technology development in the fields within the scope of its management in accordance with regulations of law.
15. Regarding management of Government’s borrowing and debt repayment, public debts, national foreign debt and international aid given to Vietnam and Vietnam’s loans and aid given to foreign countries
a) Formulate and promulgate within its competence or submit policies/regimes for management of Government’s borrowing and debt repayment, and public debts to competent authorities for promulgation in accordance with regulations of law;
b) Play the leading role in formulating and monitoring public debt safety ratios, 5-year borrowing and public debt repayment plans, 3-year debt management programs and annual borrowing and public debt repayment of the Government, annual limits on loans to be on-lent and Government guarantee limits, and submitting them to competent authorities for approval;
c) Assist the Government in consistently performing state management of borrowing and public debt repayment; performing state financial management in respect of Government’s foreign loans;
d) Organize raising of funding for state budget and development investment by means of issuance of debt instruments, conclusion of domestic and foreign loan agreements and other lawful financial sources;
dd) Act on behalf of the Government as the “Lender” in respect of loans granted to the Governments of foreign countries; act on behalf of the Government and State of Vietnam as the “Borrower”; organize negotiation and conclusion of framework agreements/international conventions on borrowing and loan agreements between the Government and foreign lenders as assigned by the Government or Prime Minister; play the leading role in requesting competent authorities to consider approving projects using ODA loans/foreign concessional loans; play the leading role in determining domestic financial mechanisms for foreign borrowing projects; organize on-lending to programs and projects approved by competent authorities; organize disbursement and recording of foreign debts in the capacity of the “Borrower”, instruct, inspect and supervise disbursement and financial management in respect of foreign loans and aid of the Government;
e) Play the leading role in formulating plans for allocation of state budget-derived funding for repaying the Government’s foreign debts; formulating plans for disbursement of ODA loans, concessional loans, and annual plans for allocation of state budget-derived reciprocal capital for ODA programs/projects;
g) Carry out issuance and management of Government guarantee issued to enterprises and policy banks in accordance with regulations of law;
h) Instruct and organize use of state budget-derived funding for repaying the Government’s loans and fulfilling obligations of guarantor; manage the Debt Repayment Fund;
i) Consistently perform state management of foreign aid given to Vietnam and loans, aid given by the Government of Vietnam to foreign countries;
k) Act as the focal point in charge of consolidating and disclosing information on debt ratios, public debt figures in accordance with regulations of law on public debt management.
16. Regarding accounting and auditing
a) Formulate and submit policies for development of accounting and auditing activities, regulations on accounting and auditing (including independent auditing and internal auditing), regimes on reporting and public disclosure on finance - budget to competent authorities for promulgation;
b) Promulgate regulations on professional and operational accounting and auditing principles, standards and methods;
c) Request competent authorities to promulgate eligibility conditions and standards for accountants, chief accountants, auditors, audit practitioners, and accounting practitioners; conditions and standards for establishment of accounting enterprises and independent audit enterprises;
d) Issue, re-issue, modify and revoke certificates of eligibility to provide accounting services, independent auditing services; certificates of registration of practicing in accounting or independent auditing; suspend practicing in accounting or independent auditing, and suspend provision of accounting services, independent auditing services in accordance with regulations of law;
dd) Instruct, inspect and supervise implementation of regulations of law on accounting, auditing, provision of accounting services, independent auditing services; practicing in accounting and independent auditing, and handling of violations against regulations of law on accounting, auditing, provision of accounting services, independent auditing services.
17. Regarding state management of securities and securities market
a) Formulate and submit legislative documents on securities and securities market to competent authorities for promulgation;
b) Formulate and submit decisions on establishment, dissolution, operating model, form of ownership, functions, rights and obligations of Vietnam Exchange, Vietnam Securities Depository and Clearing Corporation (VSDC) and subsidiaries of Vietnam Exchange to the Prime Minister for promulgation;
c) Issue, re-issue, renew, modify and revoke licenses/certificates of practicing in securities and certificates related to securities and securities market-related activities; approve changes, suspension and cancelations related to securities and securities market-related activities in accordance with regulations of law;
d) Manage, supervise and inspect securities and securities market-related activities; manage securities and securities market-related services in accordance with regulations of law;
dd) Play the leading role and cooperate with relevant authorities in implementing measures for ensuring safety and security of securities market.
18. Regarding state management of insurance business
a) Formulate and submit legislative documents on insurance business to the Government for promulgation; formulate policies for development of insurance market;
b) Issue, re-issue, modify and revoke establishment and operation licenses, suspend operations of insurance companies, re-insurance companies, foreign branches in Vietnam, insurance brokerage companies, and mutual microinsurance organizations; issue, re-issue, modify, renew and revoke licenses to establish foreign representative office in Vietnam, shut down foreign representative offices in Vietnam;
c) Inspect and supervise operations of insurance companies; re-insurance companies; foreign branches and representative offices in Vietnam; mutual microinsurance organizations; insurance brokerage companies in accordance with regulations of law;
d) Play the leading role and cooperate with relevant authorities in implementing necessary measures for ensuring the compliance of insurance market-related activities with law;
dd) Manage the use of the Fund for protection of the insured;
e) Disseminate information and forecasts about insurance market.
19. Regarding financial management of financial organizations and financial services
a) Formulate mechanisms and policies for issuance of government bonds, municipal bonds, Government-guaranteed bonds and corporate bonds in accordance with regulations of law; formulate mechanisms and policies for, and carry out issuance, re-issuance, modification, renewal and revocation of certificates of eligibility to provide credit rating services, supplemental retirement insurance products and financial institutions operating on financial market falling under state management of the Ministry of Finance as prescribed by law;
b) Formulate and submit to competent authorities for promulgation or promulgate and provide guidelines on mechanisms, policies and business models in the fields of lottery, betting, casino, prize-winning electronic games in accordance with regulations of law;
c) Inspect and take actions against violations against regulations of law on lottery, betting, casino and prize-winning electronic game business; issue, re-issue, modify, renew and revoke certificate of eligibility to engage in lottery, betting, casino and prize-winning electronic game business in accordance with regulations of law in force;
d) Formulate and submit mechanisms on State's preferential credit programs, financial mechanisms applicable to policy banks to competent authorities for promulgation in accordance with regulations of law; formulate and submit annual plans for grant of State’s development investment credit to policy banks to the Prime Minister for approval;
dd) Promulgate or request competent authorities to promulgate financial mechanisms applicable to the State Bank of Vietnam, credit institutions, Deposit Insurance of Vietnam, Vietnam Asset Management Company and other financial institutions (if any) in accordance with regulations of law;
e) Inspect printing, casting and destruction of money, and inspect management of foreign currencies for national reserve of the State Bank of Vietnam in accordance with the Government’s regulations;
g) Provide instructions for, inspect and supervise organizations providing financial services, tax consulting services and other services falling under state management of the Ministry of Finance in accordance with regulations of law.
20. Regarding customs
a) Formulate and submit specific regulations on customs procedures, customs inspection and supervision; prevention and control of smuggling and illegal transport of goods across the border to the Government or Prime Minister for promulgation;
b) Promulgate within its competence documents providing professional guidelines and instructions on customs inspection and supervision; organize implementation of regulations of law on taxes and other payables to state budget in respect of imports and exports; anti-smuggling and customs statistics in accordance with regulations of law;
c) Organize, instruct, direct, inspect and assume responsibility for performance of tasks in customs sector in accordance with regulations of the Customs Law and other regulations of law; inspect and take actions within its competence against violations against regulations of law on customs.
21. Regarding prices
a) Formulate and submit price regulation orientations to the Government or Prime Minister for approval, and organize implementation of such price regulation orientations, submit periodical or ad-hoc reports on price regulation;
b) Formulate and submit regulations on delegation of authority to perform price management tasks and mechanisms for management of prices of goods and services whose prices are set by the State to the Government for promulgation; play the leading role and cooperate with relevant Ministries, regulatory authorities and provincial People's Committees in inspecting elements constituting prices of goods and services falling under its jurisdiction as prescribed by law;
c) Cooperate with relevant ministries and authorities in formulating and submitting decisions on prices of goods and services included in the list of goods and services whose prices are set by the State to competent authorities; stipulate general valuation approaches for goods and services whose prices are set by the State; provide guidelines on application of such general valuation approaches containing specific contents at the request of ministries, regulatory authorities or provincial People's Committees;
Play the leading role and cooperate with relevant ministries and authorities in requesting competent authorities to modify the list of goods and services whose prices are set by the State at the request of ministries, regulatory authorities or provincial People's Committees.
d) Play the leading role and cooperate with relevant authorities in formulating and submitting adjustments to list of goods and services subject to price stabilization and list of goods and services subject to price declaration to competent authorities for approval;
dd) Play the leading role and cooperate with relevant authorities in formulating and submitting decisions on guidelines, measures and periods of price stabilization to competent authorities in cases where the price stabilization is carried out as prescribed;
e) Set prices of goods and services within its competence as prescribed in the law on prices and those whose prices are set by the Ministry of Finance; goods and services in different fields and industries or sectors under its management which may affect the state budget and are included in the list of goods and services whose prices are set by the State and fall under the pricing authority of the Ministry of Finance as prescribed by law at the request of the agencies assigned to take charge of appraising price methods (field, industry or sector-managing ministries or ministerial agencies);
g) Organize price negotiations in respect of goods and services falling under the management of the Ministry of Finance as prescribed;
h) Perform state management of valuation as prescribed by law; promulgate Vietnam’s valuation standards;
i) Issue, re-issue and revoke certificates of eligibility to provide valuation services; suspend provision of valuation services;
k) Play the leading role and cooperate with relevant ministries and authorities in promulgating the list of goods and services subject to price declaration; methods for implementation and receipt of price declarations;
l) Inspect compliance with law and take actions against violations against regulations on price management and valuation as prescribed;
m) Organize performance of State valuation tasks in accordance with regulations of law.
22. Regarding social insurance:
a) Organize implementation of social insurance and health insurance regimes and policies; organize collection and payment of unemployment insurance premiums and benefits;
b) Manage and use off-budget state financial funds, including: social insurance, unemployment insurance and health insurance funds;
c) Inspect implementation of regulations of law on social insurance; participation in and payment of unemployment insurance and health insurance benefits by authorities, units, employers and individuals. Inspect the use of health insurance fund by health facilities that provide covered medical services and sign contracts with social insurance agencies in accordance with regulations of law;
d) Carry out specialized inspection of payment of social insurance, unemployment insurance and health insurance premiums in accordance with regulations of law;
dd) Engage in competent authorities’ formulation and amendment of policies and laws on social insurance, unemployment insurance and health insurance.
23. Regarding statistics:
a) Formulate and organize the implementation of strategies, plans and polices for development of statistics; coordinate and organize statistical activities and provision of statistical data in accordance with regulations of law;
b) Build and consistently manage national, provincial-level and district-level statistical data systems; organize the coordination of connection and sharing of data and information between state statistical data systems; formulate standards and carry out assessment of quality of statistical data in the field of statistics;
c) Build the system of statistical indicators, statistical reporting regimes, statistical investigation and classification programs in accordance with regulations of law.
24. Regarding international cooperation
a) Conduct international integration and cooperation in the fields within the scope of its state management in accordance with regulations of law;
b) Formulate plans, negotiate and implement contents concerning economic and financial fields of international conventions and agreements according to decisions issued by the President, Government and Prime Minister of Vietnam;
c) Organize conclusion and implementation of international conventions and agreements in the fields falling under its management according to decisions issued by the President, Government and Prime Minister of Vietnam;
d) Act on behalf of the Government of Vietnam at bilateral and multilateral international economic and financial forums as assigned by the Government of Vietnam.
25. Perform state management of public services rendered in the fields within the scope of its management in accordance with regulations of law; manage and direct operations of its affiliated public administrative units; manage the Investment Support Fund in accordance with regulations of law.
26. Manage and organize implementation of plans for scientific research, application of information technology, digital transformation, innovation and statistics under its management as prescribed by law. Build, manage, carry out centralized and consistent operation on a nationwide scale of, and ensure safety and security of information systems and databases falling under its management as prescribed by law.
27. Perform state management of operations of associations in the fields within the scope of its management in accordance with regulations of law.
28. Carry out inspection and settle any received complaints and denunciations; perform the tasks of anti-corruption and misconduct; thrift practice and waste combat in use of assigned assets and funding; inspect and monitor the implementation of laws in accordance with regulations of law; take actions within its competence or request competent authorities to take actions against violations committed in the fields and industries or sectors within the scope of its management.
29. Regarding administrative reform
a) Formulate programs on innovation of public financial management mechanisms which are aimed at serving the implementation of state administrative reform programs over periods of time, and submit them to the Government for promulgation;
b) Decide and instruct the implementation of its administrative reform programs according to the objectives and contents of the state administrative reform programs approved by the Prime Minister.
30. Manage organizational structure, official payroll, number of job positions, pay grade-based structure of officials, professional title-based structure of public employees and number of persons working in public administrative units; make decisions on internal transfer, assignment, appointment, discharge, dismissal, commendation and reward, disciplinary actions; implement policies on provision of benefits; provide training and refresher courses for officials, public employees and workers within its competence in accordance with regulations of law.
31. Manage and organize performance of financial, public property, construction and development investment tasks within the scope of its management in accordance with regulations of law.
32. Perform other tasks and powers as assigned by the Government or the Prime Minister and as prescribed by law.

The organizations referred to in clauses 1 through 30 of this Article are administrative organizations in charge of assisting the Minister of Finance of Vietnam in performing the state management functions; the organizations referred to in clauses 31 through 34 of this Article are public service units; the organization referred to in clause 35 of this Article is a special unit affiliated to the Ministry of Finance of Vietnam.
The Department of National Economic Issues is comprised of 03 divisions; the Department of State Budget is comprised of 04 divisions; the Department of Investment is comprised of 04 divisions; the Department of Sector Finance - Economics is comprised of 04 divisions; the Department for Local and Territorial Economy is comprised of 04 divisions; the Department of Financial Institutions is comprised of 04 divisions; the Department of Personnel and Organization is comprised of 06 divisions; the Legal Department is comprised of 04 divisions.
The Department of Taxation is organized and operates under 03 levels: Department of Taxation (12 units); 20 Regional Sub-departments of Taxation; 350 inter-district taxation teams.
The Department of Customs is organized and operates under 03 levels: Department of Customs (12 units); 20 Regional Sub-departments of Customs; 165 border checkpoint/out-of-checkpoint customs offices.
The Agency of State Reserves is organized and operates under 02 levels: Agency of State Reserves (07 units); 15 Regional Sub-Agencies of State Reserves (comprising no more than 171 warehouse facilities).
The National Statistics Office is organized and operates under 03 levels: National Statistics Office (14 units); 63 Branches of National Statistics Office; 480 inter-district statistics teams.
The State Treasury is organized and operates under 02 levels: State Treasury (10 units); 20 Regional State Treasuries (comprising no more than 350 transaction offices).
Vietnam Social Security is organized and operates under 03 levels: Vietnam Social Security (14 units); 35 Regional Social Security Offices; 350 inter-district social security offices.
Each of the Department of Taxation, Department of Customs, Agency of State Reserves, National Statistics Office, State Treasury, State Securities Commission, and Vietnam Social Security shall have its own seal bearing National Emblem of Vietnam.
The Minister of Finance of Vietnam shall define the functions, tasks, powers and organizational structure of its affiliated organizations and units; stipulate the number of advisory and assisting units of Sub-Agencies and equivalent-level units of Agencies and equivalent-level units affiliated to the Ministry of Finance; submit the list of other public service units affiliated to the Ministry of Finance to the Prime Minister for promulgation.
The Minister of Finance of Vietnam shall assume responsibility to organize and make arrangements to put the Department of Taxation, Department of Customs, Agency of State Reserves, National Statistics Office, State Treasury, State Securities Commission, and Vietnam Social Security into operation under the new organizational model within a maximum of 03 months after this Decree comes into force.
1. This Decree comes into force from March 01, 2025.
2. The following legislative documents are abrogated:
a) The Government’s Decree No. 14/2023/ND-CP dated April 20, 2023 defining functions, tasks, powers and organizational structure of the Ministry of Finance of Vietnam;
b) The Government’s Decree No. 89/2022/ND-CP dated October 28, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Planning and Investment of Vietnam;
c) The Government’s Decree No. 89/2020/ND-CP dated August 04, 2020 defining the functions, tasks, powers and organizational structure of Vietnam Social Security;
d) The Government’s Decree No. 36/2015/ND-CP dated April 17, 2015 introducing criteria for establishment of Customs Departments of provinces, inter-provinces and central-affiliated cities; organization, tasks and operation of customs offices at all levels.
Article 6. Responsibility for implementation
1. Ministers, heads of ministerial agencies, heads of Governmental agencies, and Chairpersons of provincial People’s Committees are responsible for the implementation of this Decree.
2. The Minister of Finance of Vietnam shall assume responsibility to re-arrange 63 Sub-Agencies of Statistics affiliated to the Agency of Statistics to start their region-based organization and operation.
The Minister of Finance is assigned to consolidate and report any difficulties that arise during the implementation of this Decree to the Government for considering and making appropriate amendments to this Decree.
