To: Authorities and units affiliated to the Ministry of Construction
To implement the Government’s Resolution No. 66/NQ-CP dated March 26, 2025 on program for reduction or simplification of administrative procedures related to production and business and the Official Telegram No. 78/CD-TTg dated May 19, 2025 of the Prime Minister on focus on reduction or simplification of administrative procedures in the construction sector, the Ministry of Construction:
1. Requests authorities and units to directly direct review, reduction or simplification of administrative procedures in the sectors under their management and sharply demand their authorities and units' greatest/most ruthless determination to do so in order to make sure that at least 30% of the duration of processing administrative procedures, 30% of the administrative cost, and 30% of business conditions in 2025 are promptly reduced to meet the requirements mentioned at the Resolution No. 66/NQ-CP. Heads of authorities and units shall be responsible to the Minister for complete performance of tasks and fulfillment of objectives.
2. Assigns the Director of Department of Economics – Construction Investment Management to:
2.1. cooperate with relevant Departments in urgently formulating and proposing plans for amendments to legislative documents (study and proposal for amendments to legislative documents according to shortened procedures) and submitting such plans to the Department of Legislation for consolidation before June 03, 2025 to immediately reduce and simplify the following administrative procedures:
- procedures for issuance of construction permits to constructions under a construction investment project for which a detailed planning at the scale of 1/500 is tailored or constructions in areas for which urban designs have been approved.
- procedures for reduction in the number of construction projects having to undergo procedures for appraisal of projects and designs at construction authorities.
- administrative procedures related to construction capacity of enterprises by switching over from issuance of certificates of eligibility for construction business to self-declaration of eligibility by enterprises with ex post inspection by competent authorities; reduction in conditions for business investment in the construction sector.
2.2. review and propose List of documents containing regulations on unit price and norms to be amended so as to resolve difficulties and problems related to construction investment cost management (especially projects on investment in construction of traffic works). Review results shall be reported to the Minister before June 15, 2025.
3. Requests the Director of Department of Science, Technology, Environment and Construction Materials to preside over and cooperate with relevant Departments in reviewing and proposing List of technical standards and regulations to be amended in the construction sector to facilitate construction investment activities (especially construction planning standards); proposing List of technical standards and regulations that are no longer appropriate and are required to be annulled or amended to avoid waste during investment in construction works. Technical standard review results shall be sent to the Department of Legislation for consolidation before June 15, 2025.
4. Requests the Director of the IT Center to preside over and cooperate with Departments in conducting study and developing the plan of the Ministry of Construction for “promotion of digitalization, automation, establishment of database, serving as a basis for simplification of records and documents, procedures and reduction in the duration of processing administrative procedures in the construction sector”. It must be completed before July 30, 2025.
5. Requests authorities and units that do not propose legislative documents having administrative procedures to propose reduction or simplification of administrative procedures in their own fields (if any) to the Ministry Office for consolidation.
6. Assigns the Department of Legislation to:
- preside over and cooperate with the Ministry Office, the Department of Science, Technology, Environment and Construction Materials and the Department of Economics – Construction Investment Management in consolidating results provided by Departments of amendments to or issuance of legislative documents, or technical standards mentioned at sections 2 and 3 and including them into the program for development of legislative documents.
- closely cooperate with relevant Departments in making a draft Decree on devolution and delegation of powers over state management in construction and transport sectors and a draft Decree on distinction of powers of local governments according to the 2-level local government organization model in construction and transport sectors in order to make sure that powers to process administrative procedures for appraisal of projects, design, issuance of construction permits, and inspection of acceptance are thoroughly delegated in a manner that is appropriate to arrangement of administrative divisions and implementation of the 2-level local government organization model according to such draft Decrees.
7. Assigns the Ministry Office to:
- cooperate with Departments in urgently completing the Plan of the Ministry of Construction for reduction or simplification of administrative procedures related production and business in order to seek opinions from ministries, central and local authorities and the Prime Minister's Working Group. After the Plan is completed, a report shall be punctually sent to the Prime Minister before June 30, 2025.
- monitor and urge the implementation of the Plan for reduction or simplification of administrative procedures related production and business after it is approved and send a consolidated report on the implementation to the Minister.
- advise sending reports to the Government and the Prime Minister as requested before 25th every month.
Heads of authorities and units are required to strictly and urgently organize the implementation, send monthly reports and assume their responsibilities to the Minister for results of the performance of assigned tasks./.
