CIRCULAR
ON REGULATIONS FOR THE DEVELOPMENT, MANAGEMENT, OPERATION, UTILIZATION, AND USE OF THE TRAFFIC SECURITY AND SAFETY SURVEILLANCE SYSTEM
Pursuant to the Law on the People’s Public Security dated November 20, 2018;
Pursuant to the Law on Amendments to the Law on the People’s Public Security dated June 22, 2023;
Pursuant to the Law on Road Traffic Order and Safety dated June 27, 2024;
Pursuant to Decree No. 01/2018/ND-CP dated August 6, 2018 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Public Security;
At the request of the Director of the Traffic Police Department;
The Minister of Public Security promulgates this Circular to regulate the development, management, operation, utilization, and use of the traffic security and safety surveillance system.
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Circular stipulates regulations on the development, management, operation, utilization, and use of the traffic security and safety surveillance system (hereinafter referred to as the traffic surveillance system).
Article 2. Regulated entities
1. Police units and local police departments; commissioned officers and non-commissioned officers of the People’s Public Security (hereinafter referred to as officers) assigned tasks related to the development, management, operation, utilization, and use of the traffic surveillance system.
2. Organizations and individuals involved in the development, management, operation, utilization, and use of the traffic surveillance system.
Article 3. Principles for developing, managing, operating, utilizing, and using the traffic surveillance system
1. Comply with the provisions of this Circular and other relevant legal regulations; meet the requirements of state management in ensuring traffic security, order, and safety.
2. Ensure consistency; promote delegation and decentralization in investment, development, management, operation, utilization, and use of the traffic surveillance system.
3. Ensure the accuracy, objectivity, integrity, security, and safety of the information and data collected; ensure the security and safety of the traffic surveillance system.
Article 4. Requirements and qualifications for officers managing, operating, utilizing, and using the traffic surveillance system
1. Officers must have graduated from at least the intermediate level of the People’s Public Security education system; for officers who graduated from external disciplines, a college degree or higher in one of the following fields is required: electronics, telecommunications, information technology, along with completion of legal and public security professional training programs.
2. Officers must have a thorough understanding of the legal regulations on traffic security, order, and safety.
Chapter II
DEVELOPMENT, MANAGEMENT, OPERATION, UTILIZATION, AND USE OF THE TRAFFIC SURVEILLANCE SYSTEM
Article 5. Development of the traffic surveillance system
1. The development of the traffic surveillance system must comply with the National technical standards for the traffic security, order, and safety surveillance system and meet the following requirements:
a) Ensure timeliness, efficiency, and cost-effectiveness; prioritize the development of traffic surveillance systems on expressways, national highways, and complex roadways with significant security, order, and traffic safety concerns or those critical to socio-economic, national defense, and security development;
b) Prioritize the use of existing transmission infrastructure within the People’s Public Security; if the existing infrastructure does not meet requirements or has not been invested, lease transmission infrastructure from service providers;
c) Meet practical requirements, align with road traffic infrastructure, and ensure the ability to integrate and connect with existing traffic surveillance systems.
2. The traffic surveillance system must be designed to align with the Vietnam E-Government Architecture Framework and comply with the regulations of the Minister of Public Security on the management, connection, and data sharing of surveillance cameras within the People’s Public Security.
3. The development, upgrading, and transfer of traffic surveillance system software must adhere to the regulations of the Minister of Public Security on the development, upgrading, transfer, and maintenance of software within the People’s Public Security.
4. Before being put into use, the traffic surveillance system must be inspected and evaluated to ensure compliance with technical and professional requirements.
Article 6. Management and operation of the traffic surveillance system
1. The Traffic Police Department manages and operates the traffic surveillance system on expressways, except for those expressways assigned by the Minister of Public Security to the Province-level Police Department to organize patrols, inspections, and addressing violations.
2. Province-level Police Department manage and operate the traffic surveillance system on roadways within the administrative boundaries of their respective provinces and on expressways assigned for patrol, inspection, and addressing violations.
3. Units managing and operating the traffic surveillance system must regularly monitor, inspect, and evaluate the performance of traffic surveillance equipment, supporting devices for the traffic surveillance system, equipment installed at traffic surveillance centers, transmission lines, and system software to ensure the system operates stably. They must also regularly inspect the status and storage capacity of data in the traffic surveillance system and assess the image recording capabilities of the traffic surveillance equipment.
4. Information and data within the traffic surveillance system must be managed, categorized, and shared in compliance with the regulations of the Minister of Public Security on the management, connection, and sharing of surveillance camera data within the People’s Public Security.
5. Units managing and operating the traffic surveillance system must develop regulations for managing, operating, utilizing, and using the traffic surveillance system; and prepare plans for handling and recovering the system and data in case of system failure. Province-level Police Department must seek written opinions from the Traffic Police Department before issuing regulations on managing, operating, utilizing, and using the traffic surveillance system.
Article 7. Operation and use of the traffic surveillance system
1. Units managing and operating the traffic surveillance system operate and use information and data from the system to monitor the situation of road traffic security, order, and safety; detect and address violations of road traffic laws and other legal violations as stipulated by law.
2. The operation and use of information and data from the traffic surveillance system must comply with the regulations on the management, operation, utilization, and use of the traffic surveillance system.
3. Organizations and individuals without functions, duties, or authority in managing, operating, or utilizing the traffic surveillance system, who require access to information and data from the system, must submit a written request and receive approval from the unit managing and operating the traffic surveillance system.
Article 8. Maintenance and servicing of the traffic surveillance system
1. Units managing and operating the traffic surveillance system are responsible for its maintenance and servicing. If the unit lacks the capacity for such maintenance and servicing, it may select another organization or unit to perform these tasks while strictly supervising the process to ensure confidentiality of the system’s information.
2. The maintenance and servicing of the traffic surveillance system must comply with technical procedures for each type of equipment; the process and content of Maintenance and servicing must be recorded in the maintenance and servicing logbook as specified in the template provided in the Appendix enclosed with this Circular.
Article 9. Protection of the traffic surveillance system
1. Units managing and operating the traffic surveillance system must implement measures to prevent, deter, and address acts of intrusion or violation of the system. If an intrusion or violation of the traffic surveillance system is detected, immediate protective measures must be taken, and the managing and operating unit must be promptly notified to handle the situation in accordance with the law.
2. Police units and local authorities managing equipment and infrastructure of the traffic surveillance system located in their jurisdiction are responsible for coordinating with the units managing and operating the system to implement measures to prevent, deter, and address acts of intrusion or violation of the system.
Article 10. Responsibilities of the Traffic Police Department
1. Invest in, construct, and upgrade the traffic surveillance system under its management scope and other traffic surveillance systems as assigned by the Ministry's leadership.
2. Manage, operate, utilize, maintain, service, and protect the traffic surveillance system under its management scope in accordance with the provisions of this Circular.
3. Take the lead in coordinating with relevant units to provide guidance, monitor, inspect, and urge police units and local authorities nationwide to manage, operate, utilize, and maintain the traffic surveillance system.
Article 11. Responsibilities of Province-level Police Departments
1. Invest in, construct, and upgrade the traffic surveillance system under their management scope, excluding systems managed by the Traffic Police Department.
2. Manage, operate, utilize, maintain, service, and protect the traffic surveillance system under its management scope in accordance with the provisions of this Circular.
Article 12. Funding sources for the construction, upgrading, management, operation, utilization, maintenance, and servicing of the traffic surveillance system
1. Funding for the construction, upgrading, management, operation, utilization, maintenance, and servicing of the traffic surveillance system is guaranteed from the state budget and other lawful funding sources in accordance with legal regulations.
2. The Traffic Police Department and Province-level Police Departments are responsible for preparing estimates, managing, using, and settling accounts for the funding allocated for the construction, upgrading, management, operation, utilization, maintenance, and servicing of the traffic surveillance system in accordance with legal regulations.
3. The Department of Planning and Finance provides recommendations and reports to the Ministry's leadership to ensure funding and guide police units and local authorities in preparing estimates, managing, and utilizing the allocated funds for the construction, upgrading, management, operation, utilization, maintenance, and servicing of the traffic surveillance system.
Chapter III
IMPLEMENTATION
Article 13. Entry into force
This Circular comes into force as of January 1, 2025, and supersedes Circular No. 17/2014/TT-BCA dated April 24, 2014, of the Minister of Public Security, which regulates the operation, management, maintenance, and protection of the system for traffic surveillance and addressing violations for road traffic order and safety.
Article 14. Responsibilities for implementation
1. The Director of the Traffic Police Department is responsible for guiding, inspecting, and urging the implementation of this Circular.
2. Heads of units under the Ministry, Directors of Province-level Police Departments shall implement this Circular.
Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Public Security (through the Traffic Police Department) for timely guidance./.
