CIRCULAR
AMENDMENTS TO CIRCULAR NO. 30/2018/TT-BCT DATED OCTOBER 01, 2018 OF MINISTER OF INDUSTRY AND TRADE ELABORATING GOVERNMENT'S DECREE NO. 107/2018/ND-CP DATED AUGUST 15, 2018 ON RICE EXPORT AND CIRCULAR NO. 42/2019/TT-BCT DATED DECEMBER 18, 2019 OF MINISTER OF INDUSTRY AND TRADE AMENDING SOME PROVISIONS ON PERIODIC REPORTING IN CIRCULARS PROMULGATED OR JOINTLY PROMULGATED BY MINISTER OF INDUSTRY AND TRADE
Pursuant to the Government’s Decree No. 40/2025/ND-CP dated February 26, 2025 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade of Vietnam;
Pursuant to the Government’s Decree No. 107/2018/ND-CP dated August 15, 2018 on rice export;
Pursuant to the Government’s Decree No. 01/2025/ND-CP dated January 01, 2025 providing amendments to the Government’s Decree No.107/2018/ND-CP dated August 15, 2018 on rice export;
At the request of the Director of the Agency for Foreign Trade;
The Minister of Industry and Trade of Vietnam promulgates a Circular providing amendments to Circular No. 30/2018/TT-BCT dated October 01, 2018 of Minister of Industry and Trade elaborating the Government's Decree No. 107/2018/ND-CP dated August 15, 2018 on rice export and the Circular No. 42/2019/TT-BCT dated December 18, 2019 of Minister of Industry and Trade amending some provisions on periodic reporting in Circulars promulgated or jointly promulgated by Minister of Industry and Trade.
Article 1. Amendments to Circular No. 30/2018/TT-BCT dated October 01, 2018 of Minister of Industry and Trade elaborating Government's Decree No. 107/2018/ND-CP dated August 15, 2018 on rice export
1. Clauses 2 and 3 Article 9 are amended as follows:
“2. By the 05th each month, each exporter shall submit a report on its husked and unhusked rice inventory, sorted by rice types, to the Ministry of Industry and Trade, the Departments of Industry and Trade of provinces/cities where its head office, warehouses, milling or processing facilities are located, and also send a copy of the report to Vietnam Food Administration for the purpose of data consolidation. The report form is available in Appendix II enclosed herewith.
3. Electronic files of the reports prescribed in clauses 1, 2 of this Article and in clause 1 Article 10 of this Circular shall be sent to the Ministry of Industry and Trade of Vietnam (via the Agency for Foreign Trade) via email: xuatkhaugao@moit.gov.vn. Reports shall be submitted via the reporting software after it is put into official operation as announced by the Ministry of Industry and Trade.
In case of failure to send data via the reporting software due to its technical errors, each exporter shall update data arising during the period starting from the time of occurrence of such technical errors until the reporting software is restored to its normal operational state, and send reports via email: xuatkhaugao@moit.gov.vn; such data updating must be completed within 05 days after the reporting software is restored to its normal operational state.”
2. Clause 1 Article 10 is amended as follows:
“1. Rice exporters shall submit quarterly and annual reports which are made using Form No. 04 in the Appendix enclosed with the Decree No. 107/2018/ND-CP .
Quarterly reports shall be submitted to the Ministry of Industry and Trade by the 20th of the first month of the following quarter. Annual reports shall be submitted to the Ministry of Industry and Trade by January 20 of the following year.”
Article 2. Article 26 of the Circular No. 42/2019/TT-BCT dated December 18, 2019 of Minister of Industry and Trade amending some provisions on periodic reporting in Circulars promulgated or jointly promulgated by Minister of Industry and Trade is abrogated.
Article 3. Implementation organization
1. Vietnam E-commerce and Digital Economy Agency (iDEA) shall play the leading role and cooperate with the Agency for Foreign Trade (AFT) and relevant agencies in building the software serving submission of reports by rice exporters.
Costs of building, maintaining and developing such reporting software shall be covered with funding derived from the state budget or other funding sources.
2. The Planning-Finance Department shall instruct other Ministry's affiliated units to prepare, review and include their cost estimates in the Ministry’s annual budget estimate.
3. Any difficulties that arise during the submission of reports by exporters via the reporting software should be reported to the Ministry of Industry and Trade of Vietnam (via the Agency for Foreign Trade) for consideration.
Exporters shall update the reporting software as notified by the Ministry of Industry and Trade with reporting data arising from January 01, 2025 to the date of official operation of the reporting software.
Article 4. Effect
1. This Circular comes into force from July 18, 2025.
2. Difficulties that arise during the implementation of this Circular must be promptly reported to the Ministry of Industry and Trade (via the Agency for Foreign Trade) for consideration./.
