CIRCULAR

ON ECONOMIC-TECHNICAL CHARACTERISTICS OF MILK AND FUNCTIONAL FOODS FOR CHILDREN UNDER 06 YEARS OLD SUBJECT TO PRICE STABILIZATION AND PRICE DECLARATION

Pursuant to the Law on Prices dated June 19, 2023;

Pursuant to Decree No. 85/2024/ND-CP dated July 10, 2024 of the Government elaborating certain Articles of the Law on Prices;

Pursuant to Decree No. 95/2022/ND-CP dated November 15, 2022 of the Government on functions, tasks, powers and organizational structure of the Ministry of Health of Vietnam;

At the request of the Director General of the Vietnam Food Administration;

The Minister of Health hereby promulgates a Circular on economic-technical characteristics of milk and functional foods for children under 06 years old subject to price stabilization and price declaration.

Article 1. Scope

This Circular stipulates milk, functional foods and economic-technical characteristics of milk and functional foods for children under 06 years old subject to price stabilization and price declaration.

Article 2. Milk and functional foods for children under 06 years old subject to price stabilization and price declaration

1. Milk for children under 06 years old subject to price stabilization and price declaration is classified as follows:

a) Formula and nutrition products for children aged up to 36 months which comply with the national technical regulations promulgated by the Ministry of Health;

b) Milk and nutritious products containing animal milk in form of powder or liquid with announcement of use for children aged under 06 years, which fail to comply with the national technical regulations promulgated by the Ministry of Health or the governing ministry of the industry.

2. Functional foods for children under 06 years old subject to price declaration are classified as follows:

a) Health protection food;

b) Medicinal nutritious foods (also known as nutritious foods used for special medical purposes);

c) Food supplements;

d) Foods for special dietary uses (without milk).

Article 3. Economic-technical characteristics of milk and functional foods for children under 06 years old subject to price stabilization and price declaration

Milk and functional foods for children under 06 years old subject to price stabilization and price declaration include the following economic-technical characteristics:

1. Product name (detailed name);

2. Product classification;

3. Product form (dosage form);

4. The number of the confirmation of submission of the declaration or number of the self-declaration.

Article 4. Entry into force

1. This Circular comes into force from January 01, 2025.

2. Circular No. 30/2013/TT-BYT and Circular No. 22/2018/TT-BYT shall be invalid from the effective date of this Circular.

Article 5. Implementation

1. The Provincial People’s Committees shall be responsible for deploying the price declaration as per regulations of law on prices in a manner that enables organizations and individuals to make declaration.

2. The Vietnam Food Safety Authority – Ministry of Health shall promulgate a written request and send to Agencies assigned by the Provincial People’s Committees to receive price declarations for sending declared prices to the Ministry of Health (via the Vietnam Food Safety Authority) in order to assess market price fluctuations and develop price stabilization reports.

3. Organizations and individuals announcing milk and functional foods for use by children under 06 years old in declaration dossiers and on product labels (including products declared for use by multiple age groups, including those under 6 years old) shall send their price declarations to the agencies assigned by the provincial People's Committees to receive price declarations according to the provisions of Clause 1, Article 17 and Clause 2, Article 18 of the Government's Decree No. 85/2024/ND-CP dated July 10, 2024 elaborating certain articles of the Law on Prices.

4. The Vietnam Food Safety Authority – Ministry of Health shall take charge and cooperate with relevant units in guiding the deployment and organization of implementation of this Circular.

Organizations and individuals should report difficulties that arise during the implementation of this Circular to the Ministry of Health (via the Vietnam Food Safety Authority) for consideration and handling./.
