CIRCULAR

BASIC DESIGN OF MINERAL EXTRACTION INVESTMENT PROJECT, MINE DESIGN

Pursuant to the Law on Construction dated June 18, 2014; the Law on amendments to the Law on Construction dated June 17, 2020;

Pursuant to the Law on Geology and Minerals No. 54/2024/QH15 dated November 29, 2024;

Pursuant to the Government’s Decree No. 40/2025/ND-CP dated February 26, 2025 on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade of Vietnam;

Pursuant to the Government’s Decree No. 06/2021/ND-CP dated January 26, 2021 elaborating implementation of several regulations on quality management, construction and maintenance of construction works;

Pursuant to the Government’s Decree No. 10/2021/ND-CP dated February 09, 2021 on management of construction investment cost;

Pursuant to the Government's Decree No. 35/2023/ND-CP dated June 20, 2023 on amendments to some Articles of Decrees in the field of state management of the Ministry of Construction;

Pursuant to the Government’s Decree No. 175/2024/ND-CP dated December 30, 2024 elaborating and providing measures for implementation of the Law on Construction regarding management of construction activities;

At the request of Director of Industry Agency;

The Minister of Industry and Trade promulgates Circular on basic design of mineral extraction investment project, mine design.

Article 1. Scope and regulated entities

1. This Circular provides for basic design of mineral extraction investment project and mine design to serve mineral extraction (except for petroleum; natural water that is not natural mineral water, geothermal spring) regardless of funding sources.

2. This Circular applies to:

a. Organizations and individuals engaged in extraction of minerals;

b. Organizations and individuals providing advice on investment in construction

c. Competent state authorities according to regulations of law on construction, planning, investment, minerals and other relevant laws.

Article 2. Basic design of mineral extraction investment project

Basic design of a project on investment in extraction of minerals shall comply with the Appendix 01 (if the open-pit mining method is used), the Appendix 02 (if the shaft mining method is used), or the Appendix 03 (if the pumping method is used) enclosed with this Circular;

Article 3. Mining design serving extraction of minerals

1. Technical design of the mineral extraction investment project

Technical design of the mineral extraction investment project shall

- comply with the Appendix 04 enclosed with this Circular if the open-pit mining method is used;

- comply with the Appendix 05 enclosed with this Circular if the shaft mining method is used;

- comply with the Appendix 06 enclosed with this Circular if the pumping method is used;

2. Construction drawing design of the mineral extraction investment project

a) In case of one-step or two-step design not separately produced for each work item: Construction drawing design of the mineral extraction investment project shall

- comply with the Appendix 07 enclosed with this Circular if the open-pit mining method is used;

- comply with the Appendix 08 enclosed with this Circular if the shaft mining method is used;

- comply with the Appendix 09 enclosed with this Circular if the pumping method is used;

b) In case of two-step design separately produced for each work item and three-step design: Design in work items or work item complexes of the mineral extraction investment project shall comply with the Appendix 10 enclosed with this Circular

Article 4. Transitional clauses

1. If the basic design or the construction design created after the basic design of the mineral extraction investment project, or adjustment thereof, was submitted to a construction authority for appraisal before the effective date of this Circular but the appraisal result notification has not yet been issued, regulations in the Circular No. 26/2016/TT-BCT dated November 30, 2016 of the Minister of Industry and Trade shall apply.

2. Regarding the basic design or the construction design created after the basic design of the mineral extraction investment project other than that specified in clause 1 of this Article, regulations in this Circular shall apply.

Article 5. Effect

- This Circular takes effect from July 01, 2025.

- The Circular No. 26/2016/TT-BCT dated November 30, 2016 of the Minister of Industry and Trade shall be annulled and replaced by this Circular.

Article 6. Implementation

1. Ministries, ministerial authorities, Governmental authorities, People's Committees of provinces and central-affiliated cities and relevant organizations and individuals shall be responsible for implementing this Circular.

2. If any legislative documents referred to in this Circular are amended, supplemented or superseded, the new ones shall apply.

3. Any difficulties arising in the implementation of this Circular should be reported to the Ministry of Industry and Trade for guidance.
