Circular No. 20/2014/TT-BGTVT dated May 30, 2014, amending and supplementing a number of articles of the Circular No. 52/2013/TT-BGTVT regulating management, operation and maintenance of road works

CIRCULAR

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE CIRCULAR No. 52/2013/TT-BGTVT DATED DECEMBER 12, 2013 OF THE MINISTRY OF TRANSPORT REGULATING MANAGEMENT, OPERATION AND MAINTENANCE OF ROAD WORKS

Pursuant to the Law on Road Traffic dated November 13, 2008;

Pursuant to the Government’s Decree No. 107/2012/NĐ-CP dated December 20, 2012 defining the functions, tasks, entitlements and organizational structure of the Ministry of Transport;

Pursuant to the Government’s Decree No. 114/2010/NĐ-CP dated December 06, 2010 on construction work maintenance;

Pursuant to the Government’s Decree No. 11/2010/NĐ-CP dated February 24, 2010 regulating management and protection of road traffic infrastructure; Decree No. 100/2013/NĐ-CP dated September 03, 2013 amending and supplementing a number of articles of the Decree No. 11/2010/NĐ-CP;

Pursuant to the Government’s Decree No. 10/2013/NĐ-CP dated January 11, 2013 regulating management, use and operation of road traffic infrastructure properties;

At the request of Director General of Department of Transport Infrastructure and Director General of Directorate for Roads of Vietnam,

The Minister of Transport promulgates the Circular amending and supplementing a number of articles of the Circular No. 52/2013/TT-BGTVT dated December 12, 2013 regulating management, operation and maintenance of road works.

Article 1. Amending, supplementing Clause 3, Article 18 of the Circular No. 52/2013/TT-BGTVT

"3. Sequence and procedures for approval of central road maintenance plan (national road):

a) Directorate for Roads of Vietnam shall work out and establish road work maintenance plan and make submission to the Ministry of Transport before June 15 annually;

b) The Ministry of Transport shall carry out assessment and approval of the road work maintenance plan before July 10 annually; work out the plan, enter the costs for maintenance into the state budget accounting estimate of the Ministry of Transport and make submission to the Ministry of Finance before July 20 annually;

c) Based on the Ministry of Finance’s decision to assign state budget accounting estimate, the Ministry of Transport shall assign the plan for additional spending from central budget to the Central Fund. Central Fund Management Board shall notify spending plan for national road management and maintenance to Directorate for Roads of Vietnam.

d) Directorate for Roads of Vietnam shall check the lists of projects, work items and quantity that need to be dealt with immediately, shall be responsible for establishing the road work maintenance plan according to allocated expenditure and making submission to the Ministry of Transport within 15 days at the latest since receipt of notice as prescribed in Point c of this Clause;

dd) The Ministry of Transport shall carry out assessment and approval of road work maintenance plan and assign it to Directorate for Roads of Vietnam for implementation as regulated. Based on the approved road work maintenance plan, Directorate for Roads of Vietnam shall establish the spending plan for national road management and maintenance and make submission to Central Fund Management Board for assessment and approval.

Article 2. Replacing the Appendix II enclosed together with the Circular No. 52/2013/TT-BGTVT with the appendix enclosed hereof.

Article 3. Effect

This Circular takes effect since July 15, 2014.

Article 4. Implementation

Chief of the Ministry Office, the Chief Inspector, director generals of Directorate for Roads of Vietnam, directors of the Services of Transport of central-affiliated cities and provinces, heads of relevant agencies, organizations and individuals shall be responsible for executing this Circular./.
