Circular No. 09/2023/TT-BNNPTNT dated October 24, 2023 on promulgating lists of approved and prohibited plant protection chemicals in Vietnam

CIRCULAR

PROMULGATING LISTS OF APPROVED AND PROHIBITED PLANT PROTECTION CHEMICALS IN VIETNAM

Pursuant to the Law on Plant Protection and Quarantine No. 41/2013/QH13 dated November 25, 2013;

Pursuant to Decree No. 105/2022/ND-CP dated December 22, 2022 of the Government of Vietnam on functions, tasks, entitlements, and organizational structure of the Ministry of Agriculture and Rural Development of Vietnam;

At the request of the Director of the Plant Protection Department;

The Minister of Agriculture and Rural Development of Vietnam hereby promulgates a Circular promulgating lists of approved and prohibited plant protection chemicals in Vietnam.

Article 1. The following Lists are enclosed with this Circular

1. 1. The list of approved plant protection chemicals in Vietnam (Appendix I enclosed herewith) includes:

a) Chemicals used in farming:

- Pesticides: 712 active ingredients and 1725 trade names.

- Fungicides: 683 active ingredients and 1561 trade names.

- Herbicides: 260 active ingredients and 791 trade names.

- Rodenticides: 8 active ingredients and 43 trade names.

- Plant-growth regulators: 60 active ingredients and 178 trade names.

- Pheromones: 8 active ingredients and 8 trade names.

- Snailicides: 31 active ingredients and 152 trade names.

- Supporting Chemicals: 5 active ingredients and 6 trade names.

b) Termiticides: 16 active ingredients and 23 trade names.

c) Forest product preservatives: 7 active ingredients and 8 trade names.

d) Warehouse disinfectants: 3 active ingredients and 9 trade names.

dd) Golf course chemicals:

- Fungicides: 2 active ingredients and 2 trade names.

- Herbicides: 1 active ingredient and 1 trade name.

- Plant-growth regulators: 1 active ingredient and 1 trade name.

e) Seed treatment chemicals:

- Pesticides: 10 active ingredients and 16 trade names.

- Fungicides: 12 active ingredients and 12 trade names.

g) Chemicals for postharvest treatment of agricultural products

- 1 active ingredient and 1 trade name.

2. The List of prohibited plant protection chemicals in Vietnam (Appendix II enclosed herewith) includes:

a) Pesticides, forest product preservatives: 23 active ingredients.

b) Fungicides: 6 active ingredients.

c) Rodenticides: 1 active ingredient.

d) Herbicides: 1 active ingredient.

3. HS codes of approved and prohibited plant protection chemicals in Vietnam shall comply with Section 22 and Section 23 of Appendix I enclosed with Circular No. 11/2021/TT-BNNPTNT dated September 20, 2021 of the Minister of Agriculture and Rural Development of Vietnam. If the legislative document prescribing HS codes is amended, supplemented, or superseded, the new one shall apply.

Article 2. Entry into force

1. This Circular comes into force as of December 8, 2023.

2. Circular No. 19/2022/TT-BNNPTNT dated December 2, 2022 of the Minister of Agriculture and Rural Development of Vietnam shall expire as of the effective date of this Circular.

Article 3. Implementation responsibilities

1. The Director of the Plant Protection Department, heads of units affiliated to the Ministry, Directors of Departments of Agriculture and Rural Development of provinces and centrally affiliated cities, and relevant organizations and individuals shall implement this Circular.

2. Difficulties that arise during the implementation of this Circular shall be promptly reported to the Ministry of Agriculture and Rural Development of Vietnam (via the Plant Protection Department) for consideration and settlement./.
