ON GUIDELINES FOR DEVELOPMENT OF ECO-INDUSTRIAL PARKS
Pursuant to the Law on Investment No. 61/2020/QH14 dated June 17, 2020;
Pursuant to Decree No. 35/2022/ND-CP dated May 28, 2022 of the Government on management of industrial parks and economic zones;
Pursuant to Decree No. 89/2022/ND-CP dated October 28, 2022 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;
At the request of the Director General of the Department of Economic Zones Management;
The Minister of Planning and Investment hereby promulgates this Circular on guidelines for development of eco-industrial parks.
Article 1. Scope and regulated entities
1. Scope
This Circular provides detailed regulations on the development of eco-industrial parks and relevant forms stipulated in Articles 2, 36, 37, 38, 40, 41, 42, 43, 44, and 53 of Decree No. 35/2022/ND-CP dated May 28, 2022 of the Government on management of industrial parks and economic zones (hereinafter referred to as Decree No. 35/2022/ND-CP).
2. Regulated entities
This Circular applies to regulatory agencies, organizations, and individuals involved in the development, certification, revocation, and re-certification of eco-industrial parks and eco-enterprises.
Article 2. Industrial symbiosis and resource efficiency and cleaner production (RECP) solutions
1. Industrial symbiosis, as stipulated in Clause 7 Article 2 and Point b Clause 2 Article 37 of Decree No. 35/2022/ND-CP , includes the following cooperative activities:
a) Exchange of input and output factors (raw materials, materials, water, energy, waste, scrap materials, and other elements) in production and business operations among enterprises within the industrial park, in compliance with environmental protection regulations;
b) Shared use of production infrastructure within the industrial park, provided by entities engaged in industrial symbiosis or by a third party (excluding common technical infrastructure and social infrastructure of the industrial park provided by the industrial park infrastructure developer);
c) Shared use of services for production and business activities within the industrial park, provided by entities engaged in industrial symbiosis or by a third party inside or outside the industrial park.
2. Enterprises within the industrial park engaging in at least one of the activities specified in Points a, b, and c Clause 1 of this Article shall be considered as participating in one industrial symbiosis, as defined in Point b Clause 2 Article 37 of Decree No. 35/2022/ND-CP .
3. RECP solutions in industrial parks, as stipulated in Point c Clause 2 Article 37 of Decree No. 35/2022/ND-CP , include:
a) Waste reduction solutions at source: internal enterprise management and use of alternative materials; process and production equipment control; improvement, innovation, and replacement of equipment and production lines to optimize energy use, reduce raw material consumption, minimize waste, and enhance business efficiency;
b) Circular solutions: collection, treatment, reuse, and recycling of waste, scrap materials, and rainwater for internal production within enterprises in compliance with environmental protection regulations;
c) Product improvement solutions: design, packaging, and product modifications to reduce environmental impact.
4. During the evaluation and supervision of enterprises implementing the provisions under Point b and Point c Clause 2 Article 37 of Decree No. 35/2022/ND-CP , the competent authority may seek opinions from domestic specialized organizations and units that meet the requirements for providing consulting services on RECP solutions, or from international organizations with expertise in this field. These opinions may be collected through consultation meetings or written requests.
Article 3. RECP information and database in industrial parks
1. RECP information and database in industrial parks, as specified in Clauses 3, 4, and 5 Article 36 of Decree No. 35/2022/ND-CP , consist of platforms, data, and indicators related to RECP in industrial parks, as defined in Appendix A and Appendix B enclosed with this Circular (hereinafter referred to as the RECP information and database), including:
a) The RECP information and database at the local level, managed by the Industrial Park and Economic Zone Management Board, which is responsible for collecting, developing, managing, and operating the system to monitor, certify, revoke, and re-certify eco-industrial parks and eco-enterprises, and to perform tasks as stipulated in Clause 5 Article 36 of Decree No. 35/2022/ND-CP ;
b) The RECP information and database at the enterprise and organization level, implemented by industrial park infrastructure developers, enterprises within industrial parks, and relevant organizations, for the purpose of data collection, reporting, management, and operation to enhance efficient resource use, promote cleaner production, and facilitate industrial symbiosis among enterprises within industrial parks, under the coordination and supervision of the Industrial Park and Economic Zone Management Board.
3. The information and database system specified in Clause 1 of this Article shall be integrated into the National Information System on Industrial Parks and Economic Zones, which is developed, operated, and managed by the Ministry of Planning and Investment. The system’s online platform shall be published on the Ministry of Planning and Investment’s website.
The Industrial Park and Economic Zone Management Board, enterprises, and relevant organizations specified in Points a and b of this Clause shall be provided with online access accounts to supply and update data in the RECP database system.
1. The land area for green space, traffic, technical infrastructure, and shared social infrastructure in industrial parks, as specified in Point a Clause 3 Article 37 of Decree No. 35/2022/ND-CP , includes:
a) The land area allocated for green space in the industrial park;
b) The land area allocated for traffic within the industrial park;
c) The land area designated for technical infrastructure in the industrial park, including energy supply, public lighting, telecommunications, water supply, drainage and wastewater treatment, solid waste management, public sanitation, and other technical infrastructure systems, except for the area specified in Point b Clause 1 of this Article;
d) The land area designated for the shared social infrastructure system in the industrial park, including infrastructure for public utility services such as healthcare, education, culture, sports, commerce, accommodation facilities, parks, gardens, playgrounds, and other social infrastructure works.
2. The percentage of each type of land area specified in Clause 1 of this Article shall be determined based on the total area of the industrial park, in accordance with the industrial park construction plan approved by the competent authority.
CERTIFICATION OF ECO-INDUSTRIAL PARKS AND ECO-ENTERPRISES
Article 5. Conditions for proposing new investment in eco-industrial parks
1. The investment project proposal or the pre-feasibility study report for the development of eco-industrial park infrastructure shall include the contents specified in Point a Clause 2 Article 8 and Point a Clause 2 Article 38 of Decree No. 35/2022/ND-CP .
2. The assessment of compliance with conditions for investment in the construction and operation of eco-industrial park infrastructure, as stipulated in Point a Clause 2 Article 38, includes:
a) The anticipated key industries and sectors to be attracted to the industrial park, as determined in accordance with the approved industrial park construction plan by the competent authority;
b) The estimated emission levels for the key industries and sectors specified in Point a Clause 1 of this Article, calculated based on the greenhouse gas inventory guidelines of the Intergovernmental Panel on Climate Change (IPCC) or relevant international tools, as well as the sector-specific greenhouse gas inventory guidelines issued by competent authorities;
c) The proposed industrial symbiosis plan, categorized according to the provisions in Clause 1 Article 2 of this Circular;
d) The plan for establishing and implementing an input-output monitoring mechanism for the industrial park, covering the use of raw materials, water, energy, chemicals, waste, and scrap materials, which may be developed and implemented through the system specified in Point b Clause 1 Article 3 of this Circular;
dd) The plan for fulfilling social responsibility towards the surrounding community, which may be formulated in accordance with the Corporate Social Responsibility (CSR), Environmental, Social, and Governance (ESG) Report, or other similar sustainable development reports;
e) A commitment to compliance with the criteria for defining an eco-industrial park as stipulated in Article 37 of Decree No. 35/2022/ND-CP within eight years from the date of establishment of the industrial park, with a clearly defined implementation roadmap.

2. Forms of documents and reports related to application for certification of eco-enterprises are specified in Appendix B.
3. Forms of documents issued by regulatory agencies related to the certification of eco-industrial parks and eco-enterprises are specified in Appendix C.
REPORTS ON MONITORING AND EVALUATION OF THE PERFORMANCE OF ECO-INDUSTRIAL PARKS AND ECO-ENTERPRISES
1. The annual performance report of eco-industrial parks for the reporting year, as stipulated in Clause 1 Article 43 of Decree No. 35/2022/ND-CP , shall be prepared by the investor implementing the project for the construction and operation of eco-industrial park infrastructure (hereinafter referred to as eco-industrial park infrastructure developer and operator). The report shall be updated in the RECP database system and submitted to the Industrial Park and Economic Zone Management Board by March 31 of the following year for monitoring and supervision.
2. The annual performance report of eco-enterprises, as stipulated in Clause 2 Article 43 of Decree No. 35/2022/ND-CP , shall be prepared by eco-enterprises, updated in the database system on RECP, and submitted to both the eco-industrial park infrastructure developer and operator and the Industrial Park and Economic Zone Management Board by March 15 of the following year for monitoring and supervision.
3. Forms of reports specified in Clauses 1 and 2 of this Article are provided in Appendix A and Appendix B enclosed with this Circular.
Article 8. Evaluation of the performance of eco-industrial parks and eco-enterprises
The evaluation of the performance of eco-industrial parks and eco-enterprises, as stipulated in Clause 4 Article 43 of Decree No. 35/2022/ND-CP , shall be conducted through economic, social, and environmental indicators specified in Appendix A and Appendix B enclosed with this Circular and updated in the database system as stipulated in Article 2 of this Circular.
The Industrial Park and Economic Zone Management Board shall take the lead, in coordination with relevant Departments, sectors, and competent authorities, to perform the following tasks:
a) Annually review and assess difficulties and obstacles (if any) in the implementation of regulations on eco-industrial parks and eco-enterprises;
b) Promptly update regulations related to eco-industrial parks based on legal documents on investment, land, commerce, construction, labor, environment, and other relevant laws, and report to the Province-level People’s Committee for recommendations to the Ministry of Planning and Investment, relevant ministries, and the Government for amendments to relevant regulations on eco-industrial parks.
Article 10. Responsibilities of ministries, sectors, and local authorities
1. The Ministry of Planning and Investment is responsible for ensuring funding for the development, management, operation, mining, connection, and data sharing related to eco-industrial parks and eco-enterprises in accordance with regulations.
2. Ministries, sectors, and Province-level People’s Committees are responsible for ensuring funding and resources for updating information on eco-industrial parks and eco-enterprises.
1. This Circular comes into force as of March 15, 2025.
2. During implementation, if any issues, difficulties, or obstacles arise, People’s Committees of provinces and centrally affiliated cities (hereinafter referred to as province-level), and relevant agencies shall promptly report them to the Ministry of Planning and Investment for review and resolution within its authority./.

b) Infrastructure and services supporting enterprises in implementing industrial symbiosis within the industrial park (at least one of the following solutions):
- Energy: Infrastructure or activities aimed at optimizing energy use; investment in infrastructure and use of renewable energy.
- Water: Infrastructure/solutions supporting efficient water use and water reuse/recycling.
- Steam: Infrastructure/solutions supporting shared and efficient steam use.
- Exchange of raw materials and waste: Storage and shared information/data systems to facilitate the exchange of raw materials and waste; establishment and maintenance of communication channels for raw material and waste exchange.
- Storage infrastructure for raw materials and waste: designated shared areas within the industrial park for enterprises to store and exchange raw materials and waste for circular reuse.
1.3. Status of development and implementation of the input-output monitoring mechanism for raw materials, water, energy, chemicals, waste, and scrap materials within the industrial park
- Description of the collection and storage of information from manufacturing and business enterprises within the industrial park regarding raw materials, water, energy, chemicals, waste, and scrap materials (including data on demand, actual usage figures, and tracking or calculation tools, if available).
- Development of an input-output material management database (if applicable, specify the name and provide a brief description of this database).
- Annual report from the year preceding the application for certification of the eco-industrial park, detailing achievements in RECP, cleaner production, and emission reduction within the industrial park.
1.4. Environmental protection and corporate social responsibility (CSR) reporting for the surrounding community
- Report on the implementation of environmental protection measures in accordance with environmental laws for the year preceding the application for certification of the eco-industrial park (report already submitted to the competent regulatory authority and the Industrial Park and Economic Zone Management Board); evidence of publication on the enterprise’s website.
- Report on the implementation of CSR for the surrounding community for the year preceding the application for certification of the eco-industrial park (report already submitted to the Industrial Park and Economic Zone Management Board); evidence of publication on the enterprise’s website.
2. Report on compliance with criteria for enterprises within the industrial park
2.1. Compliance with investment, enterprise, construction, land, environmental protection, and labor laws by enterprises within the industrial park
Evaluation of compliance with investment, enterprise, construction, land, environmental protection, and labor regulations by enterprises within the industrial park for the three years preceding the application for certification as an eco-industrial park.
2.2. Implementation of industrial symbiosis and application of internationally recognized production and environmental management systems (ISO standards)
a) Forms of industrial symbiosis within the industrial park (one or more of the following):
- Exchange of input and output factors (raw materials, materials, water, energy, waste, scrap materials, and other elements) in production and business operations among enterprises within the industrial park, in compliance with environmental protection regulations;
- Shared use of production infrastructure within the industrial park, provided by entities engaged in industrial symbiosis or by a third party (excluding common technical infrastructure and social infrastructure of the industrial park provided by the industrial park infrastructure developer);
- Shared use of services for production and business activities within the industrial park, provided by entities engaged in industrial symbiosis or by a third party inside or outside the industrial park.
- Other industrial symbiosis linkages (if any, please describe).
b) Detailed description of the industrial symbiosis network (attach diagram).
c) Certified copies of Agreements/Commitments on cooperation for industrial symbiosis among enterprises within the industrial park.
