Circular No. 01/2025/TT-BXD dated March 28, 2025 on amendments to Circular No. 10/2018/TT-BGTVT on aviation staff; aviation staff training and assessment

CIRCULAR

ON AMENDMENTS TO SOME ARTICLES AND APPENDICES ATTACHED TO CIRCULAR NO. 10/2018/TT-BGTVT DATED MARCH 14, 2018 OF THE MINISTER OF TRANSPORT ON AVIATION STAFF; AVIATION STAFF TRAINING AND ASSESSMENT

Pursuant to the Law on Vietnam Civil Aviation dated June 29, 2006; the Law on amendments to Law on Vietnam Civil Aviation dated November 21, 2014;

Pursuant to Decree No. 33/2025/ND-CP dated February 25, 2025 on functions, tasks, powers and organizational structure of the Ministry of Construction of Vietnam;

At the request of the Director General of Department of Transport and Traffic Safety and Director General of Civil Aviation Authority of Vietnam;

The Minster of Construction promulgates the Circular on amendments to some articles and appendices attached to Circular No. 10/2018/TT-BGTVT dated March 14, 2018 of the Minister of Transport on aviation staff; aviation staff training and assessment.

Article 1. Amendments to some articles of Circular No. 10/2018/TT-BGTVT dated March 14, 2018 of the Minister of Transport on aviation staff; aviation staff training and assessment (hereinafter referred to as “Circular No. 10/2018/TT-BGTVT”):

1. Amendments to clause 2 Article 12 of Circular No. 10/2018/TT-BGTVT:

“2. The training programs for the titles of aviation staff prescribed in clauses 1, 2, 3, 4, 5 and 13 Article 6 shall comply with legislative documents about aviation. Aviation staff training program and detailed aviation staff training program for the remaining titles of aviation staff shall comply with Appendices 04, 04a, 05, 05a attached to this Circular.”

2. Annulment of clause 1 Article 21 of Circular No. 10/2018/TT-BGTVT .

Article 2. Amendments to some Appendices attached to Circular No. 10/2018/TT-BGTVT:

1. Amendments to Appendix 05 attached to Circular No. 10/2018/TT-BGTVT (amended by Circular No. 35/2021/TT-BGTVT dated December 17, 2021 of the Minister of Transport on amendments to some Articles of Circular No. 10/2018/TT-BGTVT dated March 14, 2018 of the Minister of Transport on aviation staff; aviation staff training and assessment):

a) No. 2 is amended and No. 2a is added to Section I, clause 4, Part B of the Rating training program prescribed in Appendix 05 as follows:

b) No. 1 and No. 4 are amended, and No.1a and No. 4a are added to Section I, clause 4, Part C of the Training program for change of rating prescribed in Appendix 05 as follows:

2. Amendments to some Appendices on aviation staff training program:

a) The Appendix 04a – “Detailed aviation training programs for operators of airports or aerodromes” prescribed in Appendix I attached to this Circular is added after Appendix 04 of Circular No. 10/2018/TT-BGTVT .

b) The Appendix 05a – “Detailed aviation training programs for air traffic assurance staff” prescribed in Appendix II attached to this Circular is added after Appendix 05 of Circular No. 10/2018/TT-BGTVT .

Article 3. Effect

1. This Circular comes into force from May 15, 2025.

2. The rating issued to air traffic controllers before the effective date of this Circular shall be valid until its expiration date. If air traffic controllers have taken training for change of rating, they are eligible to take the examination in accordance with regulations in this Circular.

3. In cases where legislative documents prescribed in this Circular are amended, supplemented, or replaced, the newer documents shall take effect.
