VỀ VIỆC ĐIỀU ƯỚC QUỐC TẾ CÓ HIỆU LỰC
Thực hiện quy định tại khoản 3 Điều 47 của Luật Ký kết, gia nhập và thực hiện điều ước quốc tế năm 2005, Bộ Ngoại giao trân trọng thông báo:
Bản ghi nhớ giữa Chính phủ nước Cộng hòa xã hội chủ nghĩa Việt Nam và Chính phủ nước Cộng hòa Ấn Độ về việc bảo tồn và tôn tạo các nhóm Tháp tại Di sản văn hóa thế giới khi Di tích Mỹ Sơn, tỉnh Quảng Nam, ký tại Niu Đê-li ngày 28 tháng 10 năm 2014, có hiệu lực kể từ ngày 28 tháng 10 năm 2014.
Bộ Ngoại giao trân trọng gửi bản sao Bản ghi nhớ theo quy định tại Điều 68 của Luật nêu trên (kèm bản dịch tiếng Việt để tham khảo)./.

The Government of the Socialist Republic of Viet Nam and the Government of the Republic of India (hereinafter referred to as “the Parties”);
Desiring to deepen the traditional friendship relation and strategic partnership between the two countries;
Recognising the common interest of both counties to cooperate in the field of conservation and restoration of the Group of Temple in the World heritage site of My Son, Quang Nam Province, Viet Nam;
Agreeing with the proposal of the Government of the Socialist Republic of Viet Nam requesting India's expertise and assistance for restoration of Temples in My Son;
Considering the ‘Initial conservation Report and Project Plan’ of May, 2011 prepared by the Archaeological Survey of India;
Have reached the following Understanding:
The project will be implemented by the ASI on behalf of the Government of the Republic of India in direct coordination with the Department of Culture, Sports and Tourism of Quang Nam Province. The Ministry of Culture, Sports and Tourism of Viet Nam, the Provincial People's Committee of Quang Nam has the responsibility to supervise Department of Culture, Sports and Tourism of Quang Nam Province in coordinating and implementing the project.
(b) The Indian side will provide technical experts and bear the cost of international air travel and salaries and allowances for experts from India.
(c) Moreover, the Indian side will cover the cost of purchasing and transporting necessary equipments and materials required for the project implementation, as well as all expenses for various studies for conducting investigations, analysis and preparation of design reports related to structural and hydrological issues of the temple site in My Son. The salaries and allowances, etc., for one (01) Vietnamese person as the Project Director/Project Coordinator, one (01) English speaking archaeologist, one (01) English speaking architect, one (01) interpreter and one (01) chauffeur and fifteen (15) number unskilled labourers for on-site work shall also be paid by the Indian side.
(d) The expenses comprising of the purchase of a multi-functional vehicle for the ASI working group, cost for running vehicle and daily-expenses such as electricity, water, telephone, internet, project maintenance expenses for the period of 5 years shall be arranged by the Indian side till the completion of the project.
The Vietnamese side will ensure the following:
(a) Exempt import taxes of any kind applicable in Viet Nam shall be levied on the import of any material or equipment from India necessary for the implementation of the project. At the end of the project implementation period, the imported equipments and materials would be allowed to be brought out of Viet Nam. If the goods are sold in Viet Nam, taxes which were exempted in accordance with the provisions of current laws of Viet Nam would have to be paid.
(b) Provide skilled workers as well as unskilled labourers shall be selected and appointed by the Vietnamese side in consultation with the Project Leader of ASI team or his representative (except 15 people regularly covered by the Indian side) to operate the site of the project. Viet Nam side will be responsible for all expenses of 100 workers in maximum.
(c) Entry passes for Indian personnel, visiting delegations, inspecting teams, experts and the Indian Embassy staff be administratively by the Vietnamese side to facilitate their visits, etc., to the project site as and when required in accordance with laws and regulations of Viet Nam.
(d) Suitable accommodation for the Indian team with proper facilities and the storage of materials near the Project site in My Son, shall be arranged by the Vietnamese side without any cost from the Indian side.
Any difference arising out of the interpretation, application or implementation of this Memorandum of Understanding shall be settled amicably through consultation or negotiation between the Parties.
The Memorandum of Understanding shall come into force on the date of its signing and shall be valid till the completion of the project.
In witness whereof, the undersigned, being duly authorized thereto by their respective Governments, have signed this Memorandum of Understanding.
